That language is from the upheld 4th Circuit Ct. App.

What Trump is, is not conservation. It is equally unconscionable and intellectually dishonest for self-proclaimed conservatives to willing permit and advocate for a Chief Magistrate to weld such power. Such power, so welded is tyranny.

The Courts have control of the Federal Marshals. Aldo, Congress needs to impeach when orders are not honored after S. Ct., rulings.

I sort of hope that the Administration defies the order. It would do two things. One, it would thoroughly piss off the Supreme Court that may be facing some other Administration reaches/challenges before long. Two, there are still some in the GOP that actually believe in the rule of law and it might serve to antagonize them as well.

Have I got the wrong guy? Wasn’t this fellow subject to a valid deportation order to any country OTHER THAN EL SALVADOR. He claimed he would be in danger from a rival El Salvadoran gang if he went home. The error alleged is not that he was subject to a judicially ordered deportation, but that El Salvador was tabu unless the gov’t showed his gang membership was no longer an extant deadly risk. A wee bit of irony there. I’m a member of a bad-ass gang but a rival gang with whom were fighting a turf war was wants me dead so I can’t go back… but I deserve the protection of the U.S from the chaos I created in my home country.

So, what happens, now. They bring him back and deport him to Antarctic or San Francisco.

The Administration argued they should be allowed to illegally deport people so any oversight from the Courts.

No Democrat President has ever voided a constitutional right by an Executive Order.

This President and this Regime is lawless. Congress needs to impeach and remove the whole lot of them. The Fed Courts need to start ordering contempt hearings and jailing all those who make decisions not to comply with their orders through the US Marshals.

It’s okay. Dr. Easter has many great friends in Saudi Arabia. Saudi Arabia can make him say the sanctioned prayers to the sanction view of God. But I didn't see SCOTUS claim his arrest was illegal, or did I miss something?

As to wrongfully held in a South American prison, isn't that a question of law in the appropriate country? No complaint of the conclusion that he was illegally removed from the custody of the US.

Yes, its a nit, but from what you have said in the past, its a significant point.

Yes, the DOJ should do everything they can to get him back to stand before the court.

BTW, I do think extraordinary rendition of terror suspects occurred under Obama as well... they may never have made it here, but I think that program was still in place under him.

I have been keeping abreast. I don’t believe that he was wrongfully detained. The courts had a problem with the lack of due process in this instance due to TPS issued for him in 2019…which in itself needs to be be investigated. When/if he is brought back…it is not my understanding that the courts will release him.

Not quite.

Yes, the extradition without due process is a violation of the rule of law. Trump's DOJ violated the system.

But LHeym the prosecutor stated that he was illegally arrested (detained), which from my reading is not something the SCOTUS stated... but I am not a lawyer and don't read briefs very well. We have attorneys to do that where I work. His statement seemed an overstatement of what the SCOTUS ruled. Functionally it makes no difference, he is supposed to be presented to the US court regardless of his status, but still...

He also claimed that "No Democratic President has ever voided a constitutional right by an executive order." Obama (and Bush, and Trump) all did do extraordinary rendition of terror suspects. Same/same, just less likely to be something SCOTUS will rule on because it doesn't happen in the US. Kind of like how much authority Trump has on this guy at this point.

I agree it doesn't give cover for 47's doing it in this manner.

Getting the guy back from El Salvador does depend on how El Salvador wants to proceed... and how much Trump wants to push the issue. The ball at this point is fully in El Salvador's courts.

That is why due process has to be given and followed.

No he was not lawfully detained.

He was detained under the color of law.

That is not the same.

Read the Circuit Court of Appeals.

His original detention was improper. He was not who the Administration said he was.

That is why these due process rights Trump Administration is violating is more than dangerous.

I thought the accuracy of the charge was a decision for trial/ hearing, not a conclusion? Isn’t the appellate panel review essentially saying that because he was shipped out we don’t know the facts? That he MAY be someone who was here rightfully?

I agree that this is why Trump’s folks should be in hot water.

I do think gang tattoos should be admissible- they are essentially a public utterance by the person who put them on. One of a number of things that are evidence. It’s not admission of guilt quite, but it is evidence. That’s for a court/judge to say. I don’t know that this guy has gang tattoos, but heard that is “why” he was considered a gang member.

Now, El Salvador is going to refuse his return. I wonder if that is a decision of El Salvador’s own design.

I’m sure El Salvador believes will garner kindness from the Regime.

If this can happen to this man, we are all in danger.

I do think gang tattoos should be admissible- they are essentially a public utterance by the person who put them on. One of a number of things that are evidence. It’s not admission of guilt quite, but it is evidence. That’s for a court/judge to say. I don’t know that this guy has gang tattoos, but heard that is “why” he was considered a gang member.

When, you are detained under the color of jaw and deboned due process that detention is illegal.

My south Texas ranch was a wasteland of human trash and excrement this time last year. It was unsafe to have my wife and son on at night. Now it is vacant desolate area again where seeing a rattlesnake is more likely than a human form.
