Hi Still, Thanks for your comment. I want to be clear that I am not accusing the game warden of acting criminally or otherwise inappropriately. Please though consider your logic that just because he ticketed an armed hunter a few minutes prior and did not shoot him he therefore could not have acted in any way inappropriately in the next case. I think that you must admit that is a bit of leap in logic. As I stated my concern is that hunters are placed in a very difficult situation where, simply becaused they legally have a firearm, the burden of proof seemingly becomes much lower in cases where they are fatally shot than in any other case, such as I mentioned about the one NY. I am sure that those officers did not shoot their prior ticketed person either. I acknowledge that I am probably not making this an exceptionally clear argument but welcome the chance to offer these thoughts. Best of all he loved the Fall.... E. Hemingway

You postulate a good question, but there are definitely ways to corroborate officers statements. No way to prove for sure. If I were the investigator, I would try to piece together the timing of the event. I would interview the officers on the other end of the radio to see if the officer sounded stressed or felt threatened. The primary respondent should have noted pupil dilation, this would tell me if the victim was flight or fight, or an assassin. The resting place of the victim and path of travel of the bullet would indicate the location of both officer and victim at the time of bullet impact. Presence and spread of powder burns would tell the distance. Blood splatter behind the victim would tell the orientation of the torso, presence of blood splatter on the weapon would indicate the position of the weapon when the bullet hit. The condition of the safety on the weapon could indicate the intention of the shooter. Depending on the ground, displaced leaves or gravel can show the direction of travel of both parties. Again, none are conclusive, but will either support or refute territory.

I understand the diference between Right and Privledge. Legally taking what your state has determined are game animals in the prescribed way and paying any required licenses or fees is a privledge that can be revoked. I am a dry land west Texas farmer and stockman. I work my soil for my living ( and a poor one at that ). I have a natural right to control pests big or small threatning my crops or cattle. I'm fortunate that my state recognizes that right as well. I'm still going to do what I have to do, and local GW's have said so. Gpopper

Here is a link to GoWilkes the bulletin board where the locals are discussing the killing of Clyde Coffey, including his niece and Minton's supporters. Quite a long read cause it's basically been daily fodder ever since April 11th. But there is a button near the top of the page where you can read the latest post, first. Some interesting revelations...Minton refused a lie detector test. He was in camo clothing. He made 2 calls...the first when he confronted Coffey and the second after killing him.

Since this thread just won't die I'll say it again: If the GW had no documented history of bad behavior before this then there is no reason to doubt his story. Anyone else agree? Could it have been handled differently? I think so, but I wasn't there.

Seems he wasn't too well liked by the local boys. Some even went so far as to say he should be reassigned to other parts or, well you know how them good ol' boys can take care of business in peculiar ways. I didn't read even one person say that Coffey had a reputation of hunting in an illegal manner. Oh, and the 'scratch' the SBI found near his treestand...all of 3 kernels of corn!

You know onefunzr2, I don't believe you would be happy if that old mans ghost came back and admitted to screwing up and that he did not give the GW any other choice. Even the rocks don't last forever.

Believe what you will. Me? Call me a Doubting Thomas. Especially since NC produced Mike NiFong, the DA who seemed to have a vendetta against those Duke frat boys. Remember that fiasco? It seems the law is applied fast and loose in that part of our country.

a local internet blog would be my first choice if I was looking for factual information... Mike Legistine actu quod scripsi? Never under estimate the internet community's ability to reply to your post with their personal rant about their tangentially related, single occurrence issue. What I have learned on AR, since 2001: 1. The proper answer to: Where is the best place in town to get a steak dinner? is…You should go to Mel's Diner and get the fried chicken. 2. Big game animals can tell the difference between .015 of an inch in diameter, 15 grains of bullet weight, and 150 fps. 3. There is a difference in the performance of two identical projectiles launched at the same velocity if they came from different cartridges. 4. While a double rifle is the perfect DGR, every 375HH bolt gun needs to be modified to carry at least 5 down. 5. While a floor plate and detachable box magazine both use a mechanical latch, only the floor plate latch is reliable. Disregard the fact that every modern military rifle uses a detachable box magazine. 6. The Remington 700 is unreliable regardless of the fact it is the basis of the USMC M40 sniper rifle for 40+ years with no changes to the receiver or extractor and is the choice of more military and law enforcement sniper units than any other rifle. 7. PF actions are not suitable for a DGR and it is irrelevant that the M1, M14, M16, & AK47 which were designed for hunting men that can shoot back are all PF actions. 8. 95 deg F in Africa is different than 95 deg F in TX or CA and that is why you must worry about ammunition temperature in Africa (even though most safaris take place in winter) but not in TX or in CA. 9. The size of a ding in a gun's finish doesn't matter, what matters is whether it’s a safe ding or not. 10. 1 in a row is a trend, 2 in a row is statistically significant, and 3 in a row is an irrefutable fact. 11. Never buy a WSM or RCM cartridge for a safari rifle or your go to rifle in the USA because if they lose your ammo you can't find replacement ammo but don't worry 280 Rem, 338-06, 35 Whelen, and all Weatherby cartridges abound in Africa and back country stores. 12. A well hit animal can run 75 yds. in the open and suddenly drop with no initial blood trail, but the one I shot from 200 yds. away that ran 10 yds. and disappeared into a thicket and was not found was lost because the bullet penciled thru. I am 100% certain of this even though I have no physical evidence. 13. A 300 Win Mag is a 500 yard elk cartridge but a 308 Win is not a 300 yard elk cartridge even though the same bullet is travelling at the same velocity at those respective distances.

Can't find stuff like this on Wilkes county TV or in newspaper reports. Nor that lots of the locals were monitoring their scanners and knew something tragic had happened within minutes. Or that Minton's girl friend ditched him after he gunned down old man Coffey. Kinda like Paul Harvey's, "The rest of the story."

Locals on scanners are a fact of LE. The cold hard facts of LE are that officers get divorced over OIS. (My opinion is that they weren't much of a spouse to begin with) There's also some truth to the old saying "if you're not getting complained on, you're not doing your job". Unsubstained complaints=doing your job and someone doesn't like it so they think if they complain long enough and loud enough they will be an officer transfered, reassigned, fired etc. Robert If we can prevent the government from wasting the labors of the people, under the pretense of taking care of them, they must become happy.
