So you admit DOGE is doling the work and not just making recommendations. Tell me statutory authority this new bureaucracy operates from. You know what is its Enabling Statute? Not for nothing, could you please provide your source and not just the quote?

This will turn out like the 140-year-olds drawing Social Security, tech-toddlers who can't read what they don't understand. Still no fraud found, just stuff Congress authorized that MAGAts don't like. "If you’re innocent why are you taking the Fifth Amendment?”- Donald Trump

Nobody point out to this idiot, or the one running/not running DOGE, that the Small Business Administration doesn't make loans. "If you’re innocent why are you taking the Fifth Amendment?”- Donald Trump

The SBA doesn't directly approve loans, but it guarantees a portion of loans made by lenders, making it easier for small businesses to secure funding. Lenders, not the SBA, make the final decision on loan approval, and the SBA's role is to reduce risk for lenders. https://www.usbank.com/busines...0funds%20they%20need. https://www.americanexpress.co...he%20loan%20payments. https://www.sba.gov/funding-programs/loans

That is not what your source waits, and would not be the first time an administrative agency acting without authority.

Administrative regulations are law if enacted under authority of an enabling statute passed by Congress. Congress would get even less done than it does if it had to pass every detail under the legislation.

Hey JTEX, you sure are quiet for a loud-mouthed Texan. We know you've read that what you are whining about, if it happened at all, happened when Trump was in charge. You got the balls to say he was facilitating fraud to give hundreds of millions of dollars to children? "If you’re innocent why are you taking the Fifth Amendment?”- Donald Trump

Civil Servants do not answer to Doge. Now, if the President is willing to allow Mysk to order his Cabinet heads to terminate civil servants in violation of federal law, that is what lawsuits are for.

It is actually not that obvious. We used to gang a framework to determine when an Agency making rules, regulations with the force of law, was constitutionally legal. The real issue was when an Agency was acting within its enabling statute when it made a specific regulation. That was Chevron and its lineage. Chevron always required an agency acting and being established by an enabling statute. We no longer have this analytical framework. DOGE, by making multi department mandates, appears to be making rules. Under our old framework, the DOGE would have to act pursuant to an enabling statute. The poorly written destruction of Chevron makes it questionable whether an enabling statute is still required for a department to engage in rule making. Now, to eliminate the necessity for an enabling statute to engage in rule making appears to me to be reading the gun that killed Chevron too far. When DOGE engages in rule making, it must do so pursuant and within the scope of an enabling statute. DOGS has no enabling statute. Now, if DOGE engaged in issuing administrative orders that is a slightly different conversation. The distinctions would be important. DOGE has to be dong either rule making or issuing administrative orders. It looks like thru are doing both at different times to me.
