There have been many alphabet agencies making "law" through administrative rules.....it was wrong then as it would be wrong now! You never seemed to have a problem with it until now....and now it isn't happening.....

It is actually not that obvious.
We used to gang a framework to determine when an Agency making rules, regulations with the force of law, was constitutionally legal. The real issue was when an Agency was acting within its enabling statute when it made a specific regulation. That was Chevron and its lineage. Chevron always required an agency acting and being established by an enabling statute.
We no longer have this analytical framework.
DOGE, by making multi department mandates, appears to be making rules. Under our old framework, the DOGE would have to act pursuant to an enabling statute.
The poorly written destruction of Chevron makes it questionable whether an enabling statute is still required for a department to engage in rule making. Now, to eliminate the necessity for an enabling statute to engage in rule making appears to me to be reading the gun that killed Chevron too far.
When DOGE engages in rule making, it must do so pursuant and within the scope of an enabling statute. DOGS has no enabling statute.
Now, if DOGE engaged in issuing administrative orders that is a slightly different conversation. The distinctions would be important.
DOGE has to be dong either rule making or issuing administrative orders. It looks like thru are doing both at different times to me.
