When then Majority Leader Sen. McConnell addressed the Senate and nation after President Trump was acquitted of impeachment in the Senate due to President Trump’s Jan 6 impeachment, Sen. McConnell implored his senatorial colleagues not to vote to convict on impeachment.

In doing so, Sen. McConnell informed the Senate that President Trump would face courts of justice for any malfeasance President Trump engaged in when President Trump was no longer president.

Article III created the Federal Judiciary.

Here is Sen. McConnell quoting Justice Story:

“Indeed, Justice Story specifically reminded that while former officials were not eligible for impeachment or conviction, they were – and this is extremely important – "still liable to be tried and punished in the ordinary tribunals of justice."

Put anther way, in the language of today: President Trump is still liable for everything he did while he was in office, as an ordinary citizen, unless the statute of limitations has run, still liable for everything he did while in office, didn't get away with anything yet – yet.”

Now, McConnell is historically wrong. The senate tried, convicted, and barred from office a Cabinet Secretary who left office and was impeached.


McConnell’s rationale for not voting to convict on impeachment also does not hold up with the recent S. Ct., decision that requires Congress to invoke the Insurrection Clause. Congress can bar a private citizen through certain constitutional tools from office.

The issue there was Cooperation la in the United State have anyways been their work legal entity. That status carries rights and obligations.

The Court just expanded the “legal fiction” of cooperate personhood that the US legal tradition has long recognized.

Now, maybe this Majority overturns at least two Supreme Court cases and grabs unqualified immunity to presidents and ex-presidents.

The Judge allowed a lot of testimony that was hearsay. He did so, for other purposes not for the truth of the matter asserted.

Here is another thing. Let us assume there are errors of law that will require the verdict to be vacated. That only demonstrates a close question of law. Only through a showing of intentional malfeasance can the legitimacy of this proceeding be questioned.

We have a Supreme Court Justice flying the flags of insurrection at his homes.

It is the far Right that is seeking to destroy us. Just like they sought to do so with the Big Lie and Jan 6 conducted at President Trumo’s will.
