On 1/6, someone was killed, and lots of property damage occurred. If that is reason to call out the guard (note that nonmilitary personnel were able to stop the rioting in less than 24 hours without them) then I am fine with using that as a benchmark to call out the guard in civil unrest. Typically, the NG gets the call after 24 hours and an inability for local LE to control the disturbance. I would have loved to have the NG called in in Minneapolis during the Floyd riots immediately… Looks to me like they do need the NG to stop rioting in CA. If Newsome is refusing to use the police to quell rioting, he should be impeached. He’s not upholding the laws of the state. | |||

Hegseth’s tenure has been a troubled one so far: It has been characterized by nonstop turmoil among his senior staff and by the scandal over his use of an unsecure Signal chat to share information about a planned military attack on the Houthis in Yemen. Even Trump has reportedly been upset with Hegseth for all the bad publicity he is generating and for his willingness to brief Elon Musk (who has substantial business interests in China) on the Pentagon’s plans for fighting China. So it is no surprise that, in dealing with the Los Angeles protests, Hegseth appears to be acting as an accelerator, rather than a brake, on the president’s worst instincts. Perhaps desperate to get back in Trump’s good graces, the defense secretary tweeted on Saturday that not only was he “mobilizing the National Guard IMMEDIATELY” but that, “if violence continues, active duty Marines at Camp Pendleton will also be mobilized — they are on high alert.” Hegseth appears all too willing to put troops in a situation they should not be in, where they risk becoming political pawns in the administration’s attempt to foment a crisis that will enable the president to assert even greater executive power. Now it will be up to the troops themselves, from Caine on down, to ensure they keep their honor clean and do not do anything that would transgress on the First Amendment rights that generations of their forebears fought to protect. A state is not the Federal District. The President does not have unilateral, direct control over a state national guard. Title 10 and Title 32 control the President’s use, mobilization of a state national guard. Even then, under these federal laws, the President cannot use a state Fed National guard for general policing. The NG in this scenario can only be used to protect Fed property and employees. Thus, I have 3 questions: Which Title has the President mobilized the state NG? Have the requirements to mobilize as set out in whichever Title the President is relying upon been followed? And What was the conditions in LA prior to mobilizing a state National Guard to LA? Until those 3 questions are answered, I withhold any opinion. If the President did not meet the requirements set out in either Title 10 or Title 32, then the NG needs to be removed. Apparently, the courts will so inform us as it should be. | |||

Scott, would you mind defining under attack? Most of the time, LE is able to handle these issues in DC. Even on 1/6 LE was able to shut down that event in hours. Admittedly, they didn’t stop it from happening, but it was stopped quite quickly. The perpetrators were arrested fairly quickly as well. Yes, Trump pardoned them… even so, I think the vast majority of them learned a lesson about civil disobedience and the price of rioting. Most of them are bright enough to know that DJT isn’t going to be riding to their rescue on his giant Qatari plane the next time. It was a domestic event. The folks involved were US citizens and thus do have some rights to assemble peaceably. When does it become an attack and the NG is allowed to start shooting at citizens? As bad as it was, I do think you need to let the rioters take the first step before you try and use force to stop them. LE is trained in restraint and probable cause/judicious use of force. The military is trained to kill people and break things. Yes, if things get far enough out of hand I agree that the NG should be called out. If they think something might happen, planning should be done by the guard and they should be ready to implement those plans. In the case of 1/6, I don’t think the guard was needed. What was needed was for LE to be told to deal with the issue; and Trump fell short of his duty. The folks who plotted insurrection should have been imprisoned and shame on the president who pardoned them. The rioters should have been arrested and charged. Again, shame on Trump for shielding them from the consequences of their bad behavior. Do you think 1/6 would have ended up better if it had been a Kent State type reaction? | |||
