They did not resolve the issue. Maybe if you go to law school you can read an opinion.

Obviously, I spotted this issue by your own admission did not believe was an issue.

Finally, I never said Title 10 was violated. I said it was a question to resolve.

What the9th Circuit said was the President may while the courts figure out the application of the Title 10. That is reasonable.

And the matter is still pending.

It is going to the S. Ct. At least, a request for Cert is.

I’ll even say. I hope he did.

I’ll go further than most here. This is why we have judicial review. I’ll accept the decision. When a final opinion is issued, I’ll read it. If the opinion does not provide actual analysis, like Dobbs, overrules precedent, or misapplies precedent I’ll say so with explanation.

However, I’ll be the first to say, the courts have spoken and do be it.

However, it is just pure fact to say right now the matter has not been resolved by the 9th Circuit. Maybe the California Governor reads the order concerning the injunction and withdraws. I would so advise.

I dont have to read the opinion eggbert. Every news outlet has their law pundit on talking about it.
I also never said it was settled, you are trying to put words in my mouth. What the pundits are saying, that if the liberal 9th all agreed the president has the right, the S court is not going to oppose, if it does go there.

I have a full rope course set up, I do a round or two on it every day. Climbing is good for you, try it sometime desk boy.

Of course, our consumer goods have went up under Trump, so keep playing games.

The 9th Circuit may resolve the issue in favor of the President, the Governor may withdraw before the matter is adjudicated, the S. Ct., may refuse to grant cert, or the S. Ct., could overturn a 9th Circuit that holds the President complied w Title. The S. Ct., may hold unconstitutional those parts of Title -0 that restrict the President.

The point is and was, as the 9th Circuit identifies, a President has to comply with a Title 10 concerning a state national guard. The courts will decide the matter they should. I never said President Trump did not comply. I said, “I do not know, but there is language to suggest he did not.” Right now we do not know the answer to the question.

The question was worth asking.

I am sorry yuh have added rabies to the list of cognitive infirmities. That can be treated, but it requires you to take FDA and CDX approved injections. Or you can just keep barking into at all the things that scare you.
