The issue in that case was:

Whether the Government complied with the National Historic Preservation Act requiring the Department of the Interior engaged in mandated consultation with tribes?

Plaintiffs' only preserved claim is that the Department violated the NHPA by issuing the LNTPs without firs meeting certain of its obligations under the PA. That is a direct quote from the case.

This was the only issue in appeal.


As a threshold issue was, Whether the Government complied with the notice requirement of rule making codified under the Administrative Procedure Act.

The Fed Circuit was overturned in dismissing and orders to rehear the matte these guide post. The Fed. District Court now has to determine whether the National Historic Preservation Act was complied with.

The 9th Circuit held the National Historic Preservation Act required consultation with the tribes prior to taking final agency action. Final agency action on this case being the LNTPs (Limited Notice To Proceed).

The Fed District court has previously denied a preliminary injunction to halt the work. They did not appeal the derail of the injunction, nor did the 9th Circuit grant an injunction. Therefore, there was no legal impediment to the work.

I have no idea after remand if the Fed. District Court subsequently granted an injunction.

Thus, the Federal Agency, in this case the Department of the Interior, Bureau of Land Management was not bypassed.

The trial court denied an injunction. Thus, work could began. The trial court dismissed for Failure to State a Claim. Therefore, work could continue. The tribes appealed on the basis the NHPA was not complied with and required their consultation. The 9th Circuit heard only that issue. Reminded for the trial court to determine whether the NHPA the application of the NHPA within this context. The 9th Circuit did not grant an injunction to prevent the work during litigation.

The trial court would certainly be proper to hear a subsequent injunction given the 9th Circuit opinion. I have no idea if that happened.

This is directly related to the OP.
The transmission line project was fast tracked through the epa, to get to the dept of interior permission. That is why the case against the Dept of int.
Different dept have to sign off.
Look up Arizona public broadcasting, as one source.

It was fast tracked through, but not by the road. It was fast tracked by the Department of the Interior.

The work was never enjoined. But for the NHPA mandate, it would not be fast tracked.

The idea seems clear, had the tribes been constantly the NHPA required the work may not have been permitted.

The matter is not resolved. The trial court could enjoin the work, order the tribes consulted, then rule that after consultation the work can continue.

Or, more likely, rule the project the dead for failure to comply with the NHPA. Then the Government had the option of starting the whole process over. I doubt they would.

Biden had some issues for sure. But in the corruption column, the trump family checks all the boxes. It's not a good analogy. The two are not the same. The entire trump empire is a grift.

And he has delivered for them in many ways. As I understand it, big oil has given millions to Trump is various ways, and there is dark money which they don't report.

This doesn't need a farce investigation which GOPers are so fond of and susceptible to. It's in plain sight.

And much of the Rightist's false equivalences presented as excuses or justifications are ladened with lies, incomplete or inconclusive investigations, and false conclusions drawn therefrom.
