There is one narrow vehicle for the suspension of Habeas in the Constitution. The President cannot do it unilaterally. The US Constitution's Suspension Clause, found in Article I, Section 9, states that the privilege of the Writ of Habeas Corpus "shall not be suspended, unless when in cases of rebellion or invasion the public safety may require it.". This means that the right to challenge illegal detention in court, which is a fundamental part of the US legal system, can only be suspended by Congress in specific circumstances. However, the last time Congress tried to suspend Habeas the S. Ct., invalidated the Act as a violation of the Constitution based on the treaty clause.
