Roland, The defense chooses the IME doctor, but I always chose someone who was unbiased or they would lose credibility. I'll always remember one time when the plaintiff's doctor said the plaintiff needed surgery and scheduled for a month later. My IME doc said he strongly disagreed with the plaintiff's doctor because the surgery should be done immediately. I also remember a time when the IME doc said that the plaintiff didn't need surgery and was a poor surgical candidate because of his numerous comorbidities.
