I am an industry recognized expert in equine orthopedics, especially of the western performance horse, and surgery. My CV in that regard stands on its own merits. I don’t seek legal work…it seeks me.

The last case I did was in Federal Court in Dallas. I was deposed by an attorney and firm you would know. It settled in mediation and never went to court. But I never was forced to submit a list. At this stage in my life, it would be impossible for me to submit an accurate list as I didn’t keep one.

It it never went to court, how was it in federal court?


OK, the suit was filed in Federal Court and the Federal Judge ordered a pre-trial attempt at mediation. But, I was deposed before mediation. Further, I was the sole expert witness on medicine in this case. The case settled in favor of the side I testified for. I was the sole expert that was actually involved in the initial group discussion at the beginning of the meditation.

I told a stry of one instance because it fit the context of this discussion.


Part of qualifying as an "expert witness" is presenting all previous examples of having been accepted as such in Court.


. . . I asked him about that above. Crickets.


I don’t remember being asked the question above but here is the answer.

Each of the multiple times I have served as an expert witness…I get asked if I have served as an expert witness before. I answer yes (except for the first obviously). Then they ask can you tell us how many times. Early on I gave them a number…latter I just replied several and don’t remember how many…as that is the truth. They ask if I can supply a list and I tell them I don’t keep a record of them…as I don’t. That is at the beginning of almost all depositions and it ends as that…never anything more.

I am an industry recognized expert in equine orthopedics, especially of the western performance horse, and surgery. My CV in that regard stands on its own merits. I don’t seek legal work…it seeks me.


I take expert depositions all the time. Can't remember the last time a retained expert witness didn't provide a list of all cases that they have testified in for the previous four years pursuant to the Notice of Deposition Duces Tecum that I serve on every expert. It is required per the Federal Rules of Civil Procedure and the Texas Rules of Civil Procedure.

Rule 195.5 Expert Disclosures and Reports. There are more requirements now!

Disclosures. Without awaiting a discovery request, a party must provide the following for any testifying expert:
(1) the expert’s name, address, and telephone number;

(2) the subject matter on which the expert will testify;

(3) the general substance of the expert’s mental impressions and opinions and a brief summary of the basis for them, or if the expert is not retained by, employed by, or otherwise subject to the control of the responding party, documents reflecting such information;

(4) if the expert is retained by, employed by, or otherwise subject to the control of the responding party:

(A) all documents, tangible things, reports, models, or data compilations that have been provided to, reviewed by, or prepared by or for the expert in anticipation of the expert’s testimony;

(B) the expert’s current resume and bibliography;

(C) the expert’s qualifications, including a list of all publications authored in the previous 10 years;

(D) except when the expert is the responding party’s attorney and is testifying to attorney fees, a list of all other cases in which, during the previous four years, the expert testified as an expert at trial or by deposition; and

(E) a statement of the compensation to be paid for the expert’s study and testimony in the case.


The last case I did was in Federal Court in Dallas. I was deposed by an attorney and firm you would know. It settled in mediation and never went to court. But I never was forced to submit a list. At this stage in my life, it would be impossible for me to submit an accurate list as I didn’t keep one.


I would think it would be child's play for an attorney to do an expert witness search of a couple of legal databases and compile a complete list.

I think ledvm and the rest of the MAGGats have the same philosophy as Trump, "go ahead and hurt the country, we don't care, as long as our guy gets elected".

Yeah, it was Democrats that stormed the Capital to keep a defeated president in power.

It was a Democrat president who reached out to the nation and decried a false election to keep power.

It was a Democrat President that refused to engage in the peaceful transition of power.

It was a Democrat that mused about hanging his VP to stay in power.

It was a Democrat who asked Republicans not to pass legislation on the border.

It was a Democrat that refused to use his power as Commander in Chief to defend our Government, our Constitution, and our election.

It is a Democratic Governor and Attorney General in Texas defying the rule of law.

It is Democrats that want to destroy religious freedom by imposing upon all citizens a sects view of God, and end government’s equal treatment of citizens when confronted with religion.

Oh wait, those were GOP/Right folks.

The GOP strategy is as follows:

1-Strengthen Putin in the Ukraine by denying aid.
2-Strengthen Hammas by denying aid.
3-Keep the border open as much as possible because President Trump’s campaign does not want President Biden to sign the bill.
4-Scapegoat and villainize gay people.
5-Ban books and art.
6/Force women w dying or dead fetuses to give birth.
7-Force children to deliver to term the products of rape.
8-Defy the S.Ct., concerning the border.

You are the abomination and not gay people.

It's not just "our guy". He is the avatar, at best. It's the worldview, and that encompasses much, much more than Trump could possibly espouse.

Folks have to understand that the threat to Republicans is existential: this is their last chance to hold onto minority rule before demographics consigns white nationalism to the same dustbin as the Whigs.

As soon as Democrats have functional majorities in both Houses and the White House the regressive Supreme Court will be dealt with and Laws that actually help people rather than corporations or the wealthy elite will be enacted, driving the last nail in the coffin holding the modern Republican Party.

They are perfectly willing to sacrifice democracy itself to avoid what's coming.

The President can solve this Texas kerfluffle with a single phone call, to the Commanding General of III Corps. That gentleman has the 1st Cav at Fort Cavazos and the 1st Armored at Fort Bliss. I suspect by the time the forward elements of each Division met at that shitty little State Park the only evidence of the Texas Guard would be skid marks.
