I was sent a link to an article that the ATF has decided trusts are bad and they are going to recommend to teh Administration that they be eliminated as legal means of registering Class III devices. Anyone else hear something about that?

I have not heard that ever. Can you provide the link you read?

I have read the new proposed CFR that would eliminate the sheriff signature and require that trusts designate responsible persons and require that they submit fingerprints and photos when applying for a tax stamp. No word on when it will be put into effect though.

It was in "The Hill" which is a fairly liberal DC gossip site. I think we're talking about the same thing; maybe I exaggerated a bit.

http://www.reginfo.gov/public/...201210&RIN=1140-AA43

quote:
DOJ/ATF RIN: 1140-AA43 Publication ID: 2012
Title: Background Checks for Principal Officers of Corporations, Trusts, and Other Legal Entities With Respect to the Making or Transferring of a National Firearms Act Firearm
Abstract: The Department of Justice is proposing to amend the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) regarding the making or transferring of a firearm under the National Firearms Act. The proposed regulations would (1) add a definition for the term (2) require each responsible person of a corporation, trust or legal entity to complete a specified form, and to submit photographs and fingerprints; (3) require that a copy of all applications to make or transfer a firearm be forwarded to the chief law enforcement officer (CLEO) of the locality in which the maker or transferee is located; and (4) eliminate the requirement for a certification signed by the CLEO.
Agency: Department of Justice(DOJ) Priority: Other Significant
RIN Status: Previously published in the Unified Agenda Agenda Stage of Rulemaking: Proposed Rule Stage
Major: No Unfunded Mandates: No
CFR Citation: 27 CFR 479
Legal Authority: 26 USC 7805
Legal Deadline: None

Trusts will not be eliminated, just make them more of a pain in the ass to use. At least the stupid sheriff signature will go away if this new CFR is enacted.

Unfortunately, the document on the ATF site indicates that a CLEO signature will be required for EVERY member of a trust.

Comment period has not yet begun. Will be 90 days of comment before the change can go into effect.

lawyer who wrote the new approach within the BATFE indicates she thinks that paperwork that has reached pending phase will not be evaluated under the old rules.

Looks like the rule of man (the CLEO) will overtake the rule of law.

We thought it might take a month for the proposed rule change to be published in the Federal Register. It did not. Was published 9/6/13 and so the comment period has begun.

Proposed NFA rule changes
