I was sent a link to an article that the ATF has decided trusts are bad and they are going to recommend to teh Administration that they be eliminated as legal means of registering Class III devices. Anyone else hear something about that?

I have read the new proposed CFR that would eliminate the sheriff signature and require that trusts designate responsible persons and require that they submit fingerprints and photos when applying for a tax stamp. No word on when it will be put into effect though.

Trusts will not be eliminated, just make them more of a pain in the ass to use. At least the stupid sheriff signature will go away if this new CFR is enacted.

mstarlingUnfortunately, the document on the ATF site indicates that a CLEO signature will be required for EVERY member of a trust.
Comment period has not yet begun. Will be 90 days of comment before the change can go into effect.
lawyer who wrote the new approach within the BATFE indicates she thinks that paperwork that has reached pending phase will not be evaluated under the old rules.
Looks like the rule of man (the CLEO) will overtake the rule of law.

mstarlingWe thought it might take a month for the proposed rule change to be published in the Federal Register. It did not. Was published 9/6/13 and so the comment period has begun.
