Using taxpayer dollars for this is BS. But the real question is: who supports allowing biological men into women’s prisons? That one has me scratching my head because I’ve never heard any reasonable person voice support for it. Brief summary: Man is on death row for murdering two of his children. Both were abused to death, with broken bones as proof. Both were about two months old. Their bodies were left in storage units. The murders happened at different times. A third child, less than 2 months old, was found alive when the man was arrested. That child had been shaken to the point of having brain bleeds on more than one occasion, and showed other signs of abuse. Man was on death row in CA, but gov Newsome halted all executions. Man now identifies as female and is placed into women’s facilities where his ex/baby momma is incarcerated. She petitioned to be moved to a different facility(she had contended that he had threatened to kill her if she spoke to police about the murders). Man, now a trans woman, is in women’s prison awaiting tax payer funded breast implants. -end- I wonder why the main stream media ignored this story? Maybe it is a hoax? Interesting theories, Jeff. I doubt there is precedent to support your interpretations, though I agree they are sensible readings of the Sixth and Eighth amendments. Upholding your interpretation, and actually requiring speedy trials, would require a lot more resources for a judicial system already overburdened by criminal cases. A court can't tell a legislature how much to budget for the judicial process. Also, it's often the defendant who moves to delay trial and files long drawn out appeals. | |||

Also, the Defense has to invoke the right to speedy trail by motion if it feels it needs to. The right to trial would not include the right to punishment. Felony trials are split into two phases a trial of guilty, and then a mini trial for assessment of punishment. Defendants can and has waived their rights to appeal to receive the death penalty. That is few and far between. Hard to complain when the Defendant is doing the appealing. In KY we do not execute the mentally incompetent. That is regardless of what stage mental incompetence manifest. Our courts have not walked back from that guiding star, but the Department of Corrections refuse to draft a reg that addresses that concern. So, whenever the deadline for a prison approaches they appeal; and win. | |||
