Judge will let "reasonable people" decide if Burger King has been lying about the size of its Whopper. BK hates that! Aug 29 (Reuters) - A U.S. judge has rejected Burger King's bid to dismiss a lawsuit claiming that it cheated hungry customers by making its Whopper sandwich appear larger than it actually is. U.S. District Judge Roy Altman in Miami said Burger King must defend against a claim that its depiction of Whoppers on in-store menu boards mislead reasonable customers, amounting to a breach of contract. Customers in the proposed class action accused Burger King of portraying burgers with ingredients that "overflow over the bun," making it appear the burgers are 35% larger and contain more than double the meat than the chain serves. Burger King, a unit of Restaurant Brands International (QSR.TO), countered that it wasn't required to deliver burgers that look "exactly like the picture," but the judge said it was up to jurors to "tell us what reasonable people think." There is hope, even when your brain tells you there isn’t. – John Green, author

i was "exposed" to food photography about 100 years ago -- it's rather interesting that they don't actually (usually) use edible food -- they use steamers on frozen foods, use glue rather than milk for shakes, and (on the steamers) for example, a turkey shown steaming was worked over with steamers and torches, to show golden skin and a flap of perfectly juicy turkey.. was, in fact, a largely frozen HUNK of turkey -- and none of it was actually "food". if a patty looks 35% larger, i bet it was frozen in the core, but treated to look like a juicy patty ... not cooked, as that shrinks opinions vary band of bubbas and STC hunting Club Information on Ammoguide about the416AR, 458AR, 470AR, 500AR What is an AR round? It's called advertising and plaintiffs' lawyers are the scum of the earth. Now, even assuming liability, what are the damages? The difference between the value of the first hamburger you purchased and the what you thought you purchased? Once you buy the second hamburger, you just capped your damages.

CLASSIC America! Everyone looses. Except the bloody lawyers. You don't like their burgers, don't buy them. Why go to court? Oh sorry, people are too stupid to think for themselves there. Just look at who they ELECT to rule them!
