GOOD FOR HER! Running for office and ANYTHING associated with it is a personal choice and is NOT an official act of any type of employment.

I don't get how SCOTUS could declare that any conversation in the WH about UNOFFICIAL acts should be protected. Where is the precedence for that? UNOFFICIAL IS UNOFFICIAL no matter where or when.

According to that article, the judge said Trump could bring another motion to dismiss once all issues relating to immunity are resolved. So celebration by those of us who see Trump clearly is premature.

If Trump wins the election, you can bet he'll order his AG to fire the special prosecutor and drop the case.

Just as he allegedly had AG Barr drop the investigation of the ten million paid by Egypt to the Trump 2016 campaign.

I'm wondering what will happen when he loses the election.

It's hard to imagine the legal hell on him.

The fly in the ointment for the Orange Moron is that in order to determine which, if any, of the charges relate to "official" acts, the Judge will likely require what's being referred to as a "mini-trial" with much of the evidence against him presented in open court.

Probably starting in September.

There's a very good chance the American People will get to function as his jury, with all the evidence publicly disclosed before November.

I wonder how Trump would prove his actions were "official" without testifying. I can't imagine him taking the witness stand.

If Trump doesn't offer some evidence, what is there to hold a hearing ("mini-trial") about?

If it were a civil case, I'd expect the issue to be decided by summary judgment, without an evidentiary hearing. I don't know applicable procedure on a criminal case like this one.

Maybe it's a jury issue.

As I understand it the determination of official/non-official will be very much like a jury trial without a jury, the evidence of acts committed will be presented.
