Well, the Colorado Civil Rights Commission felt it was worthy of taking to the SCOTUS.

I say that any gov't entity that pursues litigation against a citizen and loses their case should cease to exist,
Just the same as a when a congressperson puts forth legislation which is found to be unconstitutional should immediately lose their seat and be dismissed without any further compensation.

I like it!

And I'll raise you one.

Any lawyer that takes a case that is dismissed on summary judgement should be disbarred!

Me neither. There was a time when baking it would have been illegal...do I correctly remember a Supreme Court Justice stating that he could not define pornography but he knew it when he saw it?

Typical. No. They did not ask for a penis cake. That must come from your vivid imagination regarding such things. dancing

From the opinion by SCOTUS:

"Phillips met Charlie Craig and Dave Mullins when they entered his shop in the summer of 2012. Craig and Mullins were planning to marry. At that time, Colorado did not recognize same-sex marriages, so the couple planned to wed legally in Massachusetts and afterwards to host a reception for their family and friends in Denver. To prepare for their celebration, Craig and Mullins visited the shop and told Phillips that they were interested in ordering a cake for "our wedding." Id., at 152 (emphasis deleted). They did not mention the design of the cake they envisioned.

As to how many genders, depends on how you want to look at it.

Genetically, 2. There are some genetic errors that come across as being asexual, but mostly they do show some sort of primary sexual organs.

Phenotypically, there are still 2, but the apparent may be different than the genetic.

What we are really talking about here is more an issue of mental health- someone who is distressed in some way with what nature gave them.

In the old days, a transsexual was someone who dressed/acted like a member of the opposite sex, and usually they didn’t identify as such, just liked doing it for whatever reason.

I am beginning to think that there is a lot of angst in the younger generations about societal roles and a deep unhappiness in lots of folks, and this is how they express it. Society is stating this is an acceptable expression, and folks are using it to protest how they don’t like society is telling them to live. Interestingly, most transgender folks do state that they are interested sexually in cisgendered folks, even if both genders. It’s not unusual to hear them state that it’s “complex” and “I don’t want you to label me!”

So is this a pathology on the part of the person… or society?

Genders and confusion. Much of this started a long time ago.

I came of age in the 80's so this was my music. I like looking back on it now. Here is an interesting person who did some terrible things to himself over time. He was a very handsome man at the time of this video.

When you read his bio it is clear why he was so messed up. He had quite an interesting attitude despite what he ended up looking like. Had a tragic end as usual.

Pete Burns Bio

There are many others who have distorted themselves. Michael Jackson, Cher, etc. Much of this is probably spurred by some sort of mental issue.

Only if you're dumb enough to accept some blogger's internet posting (that actually includes a photo of the cake that was never baked) rather than an opinion written by the SCOTUS.

I'll try again:

From the opinion by SCOTUS:

"Phillips met Charlie Craig and Dave Mullins when they entered his shop in the summer of 2012. Craig and Mullins were planning to marry. At that time, Colorado did not recognize same-sex marriages, so the couple planned to wed legally in Massachusetts and afterwards to host a reception for their family and friends in Denver. Lane, the SCOTUS typically analyzes the factual record pretty carefully before they write an opinion. The specific statement in the opinion is "They did not mention the design of the cake they envisioned." If there was some evidence in the record that they had asked for a penis cake, I can't imagine the SCOTUS wouldn't have included that in their opinion.

And, more importantly, I am pretty sure that if this absurd penis cake thing was true, it would have been included in the factual recitation in the opinion. That sort of thing would be something that would add support to the decision in the minds of the conservative wing of the Court.

And, frankly, in my opinion as well. I wouldn't disagree with the decision of a cake shop not to produce such a thing. Gay or not.

Take this, JTEX:

The best source anyone's been able to find for the "penis cake" story is a blog with 17,600 followers?

The counselor is correct. If it had been a penis cake, the Supreme Court would have noted it in the opinion. Legitimate news sources also would have reported it.

To settle the debate, could drive over there and ask at te shop exactly what was requested - if they are allowed to discuss that (I suspect they are).
I hear they make a great German Chocolate cake and its been a while since I’ve had one…

Yes, I'd like to hear what Huvius learns. I'd bet the cakeshop owner is tired of fielding questions about it though.

One of my coworkers is disgusted because they put litter boxes in the bathroom at her 1st grader’s school for the “furries”.

My suggestion was to show the statute that allows unattended animals to be shot on private property and suggest to the furries parents that maybe they better get the kid some serious help.

For the third time. The SCOTUS makes this specific statement. The factual record in a case that reaches the SCOTUS level is pretty specific. If a penis cake had been requested, that would have been something in the record because it supports (in my opinion) the result that was reached.

I see that the predilection for irrelevancy is still alive and well here, as is the proclivity for never actually coming to a conclusion on any given topic.

Did we ever sort out how many genders there are?

Allowing for genetic anomolies, my vote is for three: male, female, and "none of the above."

As for the cake thing, the entire discussion is worthless until there is a definite answer about the nature of the requested cake in question. If they did request a penis cake, then would anyone here actually be in favor of forcing the bakery to make it?

I'd like to think not, but I could be wrong; there are several losers here who honestly believe that healthy people should be forced by the government to be injected with experimental and untested pharmecutical products.

If the customers did not request a penis cake, then in my opinion it would be bad business to refuse - however, it would also be the business owners' right to do so. I would never ask a muslim caterer to provide me with a pig roast or pork barbecue, nor would I expect a Native American baker to bake me a cake decorated to celebrate Custer's birthday, just to prove a point. coffee

We see in this thread the same defective reasoning that leads some to claim the election was stolen. The only "authority" to support the penis cake claim is a low-viewer blog.

Let's digress a minute to think about what an internet blog is. It's not a fact reporter. Unlike a newspaper or even the TV media, there are no gate-keepers for the information presented to provide assurance that the facts have actually been investigated and are as reported. (Science papers have their peer review.) The person writing a blog, on the other hand, only answers to themself. They might report any urban legend or rumor as the facts...and there is no one to say them nay.

So now, we turn away from an isolated blog and look at the rest of the world. So far as I can discern, no one here, despite their best web searches, can find any support for the penis cake claim. Just that one blog.

No established or reputable media outlet reported it. (And when do they ever pass up a salacious fact?)

The Supreme Court opinions didn't mention it.

No one's even found another blog that makes the claim.

Logical minds will recognize that the penis-cake has not made its burden of proof. Yet, some here consider it a legitimate issue worth debating.
