Story by Elie Honig • 5h • 4 min read

(excerpt)

Even if you take every word of the House Oversight Committee’s report on January 6 as gospel — and, please, don’t — Liz Cheney did not commit a crime. It’s not close. The suggestion to the contrary by the Republicans who ran the Committee betrays that they either have no clue about criminal law or don’t care because the politics of payback reign supreme.

The Oversight Committee tries to apply lipstick to its pig by declaring solemnly that it is making a formal “criminal referral” of Cheney to the Justice Department. Big deal.

There’s a superficially symmetrical bit of tit-for-tat in the Oversight report. Just as the Select Committee ceremonially referred Trump to the Justice Department for criminal investigation, so too does the Oversight Committee refer Cheney for potential criminal charges. Both ways, this act of a formal “criminal referral” to DOJ is pure political theater and legally meaningless. The Justice Department does not need a criminal referral from anyone to do anything. Nor does a criminal referral require DOJ to do anything.

this will be an early litmus test for the incoming administration. Attorney-general nominee Pam Bondi has plenty of prosecutorial experience, and she should see the lack of merit in this referral immediately. Same goes for Todd Blanche, who is in line to become deputy AG.

If DOJ lets the Committee’s report slide away into the political muck whence it came, that’s a sign the new AG is playing it straight. But if the Justice Department takes this seriously and pursues the Committee’s misguided fantasy of a Cheney prosecution, then we’ll know they’re off the rails.

I always am in awe when ME reads some tripe and it immediately becomes his Gospel.

Anyway, I think it would be a bit more informative and accurate to know how tight Liz Cheney’s self righteous sphincter is now that she may well be indicted (or have to accept a pardon). I can assure you she’s aware she bit off far more than she can chew.

When Eric Hoffer’s True Believers (here Cheney) put the ends over the means…. Sometimes the goal is too tempting in their religious fervor and breaking a meaningless little law here or there just is the right thing to do.

Personally, I hope she’s prospectively pardoned and goes, shamed into the dust bin of history. Two reasons: There are bigger fish to fry and TDS is a real disease. Just disbar her as Slick Willie was. She certainly earned that and it’ll not take up the DOJ’s resources.

You must post from a phone often. You're forgiven for typos and sometimes not being clear.

I suppose you mean the three who posted above in support of prosecuting Cheney, IOW they believe in Trump's lies and revenge lawfare.

All three are shameful, but you're right, especially the Judge. Apparently, he hijacked the title.

It really is amazing how wrong they are. I don't have a good explanation for it. I read an article today where the author blamed the Rightist media such as Faux News and the Sinclair group, Newsmax, etc., and started to post it for discussion. But in posting it I would have to disagree with the author, mostly. While the people such as the three so far in this thread have obviously been brain farted somehow, perhaps the Rightist propaganda media is the culprit, and they are/were obviously vulnerable to Trump's demagogue magic spell, I don't think it's entirely the media's fault. They, the Rightist media and Trump, just exploited something already there, with some fomenting to top it off. And it paid dividends. IOW, in a cause-and-effect scenario, I don't think the media is the cause. I think media like Faux News supplied the market demand already there.

It's just sadly the Belief in Fiction is hungry and needs feeding.

I'm still of the opinion that what's wrong with these people is entirely on them. They are helpless. It's useless to wish they would get better somehow. But I think it's reasonable to wish they had no influence on anything that matters to me. It would please me greatly if their yapping meant nothing. But unfortunately, it does mean something. We are entering the REAL Trumpism era. It's gonna get worse and maybe not better for a long time.

What the heck, I'll post a link anyway. Note, I didn't post the article from the New Republic because that source required that I register to read it again. But I found another source for the same article:

Oliver Wendell Holmes, while at Harvard sent a review of a work of Plato's to Ralph Waldo Emerson, who returned the review with those words. "When you strike at the king you must kill him." Liz didn’t.

I pointed out that Cheney knows better than anyone if she has anything to worry about. I made the mistake in believing that any TDS sufferer here would read the Congressional referral first before making personal attacks against the messenger. (Or even know that a Congressional referral is not a probable cause document.) I was wrong.

If Cheney suborned perjury, attempted to have a witness’ attorney disbarred under false pretenses and communicated with a witness without counsel present, she should be prosecuted. Anyone disagree? Regardless of the “greater good” she was trying to accomplish? She was trying to kill the king. She failed so every discoverable effort towards that end is subject to inquiry (and criminal inquiry at that).

The referral isn’t an indictment. It’s only a suggestion/request to the DOJ that the committee believes that an investigation is needed to determine the possible or probable criminal nature of discovered evidence.

Again, Liz knows if she did anything wrong. She’s seen and encouraged “lawfare” against others. With that knowledge, I’m betting her sphincter is a little tighter today than when the “blue wave” was still a $1.5 billion fantasy.

And, btw, my skin isn’t so soft that personal attacks bother me. I just chalk them up to more evidence of the character and intelligence (and severity of TDS) of the attacker. I’m sure other readers here do the same.

I believe this is likely to happen. If it does, everyone can draw their own conclusions. I will certainly draw mine. What law did Cheney break??? I am not sure…maybe none. But, as the gentlemanly Judge Ernest said, she knows. But with that said, laws broken or not…her work on that committee was certainly less than fair and equitable.

"When you strike at the king you must kill him."

That could be interpreted several ways. I'm sure by using the term "King" in referring to Trump, you mean it literally and expect us to take it metaphorically. Also, the stated purpose of the 1/6 committee was to discover and report on the events leading to, during and after the riots, not specifically to strike Trump. But being the center of it all, it would have been a farce to avoid focus on Trump during the investigation and in writing the report. After all, the riot and break-in wouldn't have happened except for Trump and his lies including the BIG LIE, and importantly the active participating and enabling of some or most GOPers in congress.

After all, let's not forget the riots and break-in was all about delaying the certification so Trump's loyalist GOPers could recognize the fake electors and anoint the King. It was the PLAN and almost worked. Trump actually said so.

Those GOPers in congress wanted to destroy the inquiry of the committee from within and were denied the opportunity. Instead, two republicans who were not about corrupting the investigation were on the committee.

So, the GOPers protecting the King had little choice in controlling the narrative but to issue their predetermined report to distort. TP money spent to fabricate lies and cover for previous lies.

If anyone should be prosecuted it should start with Mike Johnson and Gym Jordon for their part in fomenting and helping with the attempted insurrection.

And it's not that your skin is soft. Instead, it's that your head is hard.

Year 2024 lined back up in statistical norm. When looking at 2020 now…it is even more of a statistical anomaly with a post-20 election added to graphs.

There are actually 2 Big Lies…FYI.

1) The Russian Collusion Hoax - it will go down in history as the biggest hoax ever perpetrated on the American public.

2) That the Democrats did NOT use the Covid Crisis to manipulate the 2020 election. Looking at the vote over time graphs with 2024 added…virtually impossible that the 2020 vote counts were “natural.”

Strange that you find no "statistical anomaly" in so many States voting Democratic for every office except President, contrary to all precedent, or so many voters voting only for the Presidential race but no others on the same ballot. Perhaps you can explain the "anomaly" in North Carolina where every state-wide race was won by the Democrat except the Presidential...

I'm open to seeing proof that the Mueller investigation and report was a hoax.
I don't believe Robert Mueller would get involved in a Hoax. I believe Bill Barr would. I also believe many GOPers in congress would spin the hoax narrative. So would Faux News.

I don't believe they would open an investigation like that, so significant, without probable cause suggesting Trump campaign communicated for coordination with Russian dis/misinformation spew and the leaks from wiki. There were so many red flags - Manafort had connections, so did Flynn and Stone and several others. The clandestine back channels were available, wide open. There is no reason whatsoever that Trump and Team were so ethical as to not use them.

Focus on proof. Show me. I want facts that prove the hoax you claim. You made the claim practically from the beginning, so the burden is on you. I don't want to prove it for you.

The obvious coordination and foreknowledge of the hacked emails leaks, content and timing, is enough to infer collusion for me. But there was a lot more.

"show proof" -- exactly, maggie, SHOW PROOF -- of it changing the results -- hacking didn't start, or end, and was not limited to the DNC falling for a phishing email - what back channels? mueller didn't report on that -- but the PROOF i need is for dominion voting machines to come out and say "russians hacked out voting machines" and then EXPLAIN how killary won the popular vote....

there is a phrase, that I learned from Mandiant 2 decades ago, regarding cyber "attestation is hard" - "leaks" ,,, you are serious -ly deranged -- much like YOU didn't understand standing the phrase "acting", this is way way way outside your skillset

oh, wait, i hear SNL calling ou

The premise of the Mueller investigation was the hoax. The cost of the Mueller investigation was the painful penitence we had to pay for your and your ilk’s gullibility.

The findings of Mueller along with the prosecutions (nothing to do with the election) are the proof it was a hoax.

First you need to read special council John Durham's report.
He found the FBI guilty of malfeasance in their work. Lies and document changes to get fisa warrants and so on.

You better get to believing because that is exactly what they did. Actually it is even worse…they manufactured probable cause with Carter Page.

What gets me is that a large number of the people in the country are apparently OK with spending millions of dollars for the production of political theatre. Did Liz Cheney break some laws? I don't know and I don't care. It is not important to the nation either way. There are a lot of things which are important. We should worry about them. Bill

It’s amazing that so many people are this brainwashed. Either that or they are lying and expect everyone else to believe their lies.

Oh boy. Crying about “irregularities” again. Everyone played by the same rules, but republicans were too stupid to figure out how to vote.

Actually they voted exactly in the expected trend right in the linear curve between the rest of history and 2024. The anomaly comes in the form of Biden votes in 2020.

What they didn’t do is exploit the rules with NGO’s harvesting votes and hand delivering them.
