I have been reading various articles on the status and assessment of the prosecution's case including Fox, Newsweek, WP, NYT, and others.

The critique, assessments, etc. show the stark difference between practically all media sources that I frequent and Fox.

Fox blurp in general promotes the narrative that it's all a farce, political persecution, breakdown of the rule of law, with many flaws in the evidence.

Truthful media reports that the prosecution's case is very good, and the defense is lame.

I assume that a guilty verdict on some or all counts will be appealed. Will Fox's tune change? I predict no. Instead, they will double-down, and so will Trump.

Also, a bunch of political GOPers have showed up outside the court to show solidarity with their "friend" Trump and give stump speeches.

They have been setting up the spin from Day One. The judge was a hack, the judge was conflicted, the trial was in NYC, the prosecution was unjustified, the witnesses were liars . . . the spin has been about everything but the facts and the law. There is a saying, if the facts are against you, argue the law; if the law is against you, argue the facts; if the law and the facts are against you, pound the table and yell like hell. That's all we have heard from the defense.

NY vs. Trump: My experience as an NYC juror leads me to believe the unthinkable could happen

Opinion by Deroy Murdock • 6h •

Murdoch - Murdock

Humm

Anyway, this article is full of lies.

here's the bottom lines:

My memories of jury duty, including within the Stalinesque building in which Trump is being persecuted, tell me that deliberating jurors could think, "I won’t vote for Trump. But I cannot convict him beyond a reasonable doubt in a shaky case about actions that are lurid, but legal.

If just one juror agrees, this case will end with a hung jury. A second trial would be unlikely before Election Day.

But it is the most liberal jury pool the world knows…so it is a possibility.

If the crime is falsifying tax records, that’s much more a federal offense.

If the crime is hiding a payment in a political campaign, that’s a federal offense.

If the FEC said no to prosecuting that, how is it a state issue re elections?

And if it is all about placing a personal payment into the business accounts, why do they bring the porn actress in to make all kinds of testimony other than I was paid… here is the NDA I signed. Here are the deposits. Here is my tax payment for this consideration.

Depending upon how the $130+K was handled when filing the tax returns may or may not be a tax law violation. Whether or not SD declared and paid taxes on the $130K is irrelevant.

I think bottom line is that lying and deceit is okay with you. You won't admit that, but your repeated defenses of Trump's lies over the years and your dismissive attitude towards actions involving deceit tell a very different story. First you defended as a nothing burger someone materially falsifying certified financial statements that they used to obtain millions of dollars of loans. Now someone falsifying business records to conceal the true nature of an expense is just a political persecution. Pretty clear that in your world, depending on your politics, dishonesty is more a virtue than a vice.

Let’s see how this one plays out. There is not evidence that he falsified anything here.

In the other…the bank testified that it was completely happy with the financial statement and wouldn’t have changed a thing for them.

Both cases of Lawfare. Your hatred blinds you.

. . . please share with us that testimony. coffee

Your comment is specious and cannot even hold up to the application of a minimal amount of common sense. What banker representing a major lending institution is going to testify that our institution does not care if a potential borrower falsifies the financial statements that they provide to us to secure a loan and the terms of our loans would not vary based on what is included in such falsified financial statements. It is ludicrous to even suggest that someone would so testify . . . so we will sit tight while you provide us with that testimony.

But, testifying for the defense, managing director David Williams said the bankers viewed clients’ reports of their net worth as “subjective or subject to estimates” and took its own view of such financial statements.

“I think we expect clients-provided information to be accurate. At the same time, it’s not an industry standard that these statements be audited. They’re largely reliant on the use of estimates,” Williams said, so bankers routinely “make some adjustments.”

At times, the bank pegged Trump’s wealth at several billion dollars lower than he did, according to documents and testimony. In 2019, for example, Trump’s financial statement listed his net worth at $5.8 billion, which the bank adjusted down to $2.5 billion.

But Williams said such differences weren’t necessarily unusual or alarming.

“It’s a conservative measure to make these adjustments,” he testified, characterizing them as “standard” and a “stress test” of financial strength.

That does not say they were completely happy.

It simply says they did not audit.

That does not affect the cupidity of the Trump Organization.

David Williams was the lending officer. He found the financial statement within the norm and noted they are only meant as estimates. He went on to say the bank was happy.

Engoron stipulated the lender was happy.

Williams testimony is summarized on page 22 of Engoron’s order. No where in that summary is it stated the Deutsche Bank was happy with the financial statements or that the bank would not have altered the lending terms had the bank been given accurate financial statements. Williams does say that he would expect a client to provide truthful and accurate information to the bank and that such information is significant in the decision to underwrite a loan. And, interestingly enough, Deutsche Bank chose to exit its relationship with Trump in 2021. Wonder why?

I do not think Dr. Easter realizes that the Judge on making his ruling wo a jury (bc President Trump could not hire a competent lawyer in part) had to make specific findings of fact summarizing the factual findings from the record (witness testimony and exhibits).

This is required to make a record to allow appellate review as the appellate court has to see the facts as found by the Judge setting as fact finder, those facts applied to the law, and legal conclusions the Judge reached.

Wo this factual finding by the Judge in his order there is no why for a appellate court to address whether the facts present mandated a different legal conclusion as a matter of law, if there exists substantial evidence to permit a legal conclusion, or whether the facts as determined by Judge factual findings for clear error; meaning the appellate court shall not disturb factual findings unless they are not supported by substantial evidence. Miranda v. Miranda, 536 S.W.3d 196, 198 (Ky. App. 2017).

He can cite Bloomberg, Fox News, guys on Twitter all he wants. They are not controlling. They are not even real. What matters is the record of the trial court and findings of fact the Judge made setting as fact finder.

Simply, that an appellate court would have decided a factual issue differently shall not suffice to overturn a factual finding and the legal conclusion that is set upon that fact.

Dishonest my ass. Williams states these financial statements are merely estimates. He stated that even with the discrepancies noted that they were within the norm. He said the bank was happy with the deal. He says all obligations were met.

Deutsche Bank quit doing business with Trump not because of any bad interactions. In fact they made a lot of money on Trump deals. They quit because they like to maintain a low profile with law enforcement and Trump was made a target. They didn’t want the exposure.

The net take home from Deutsche Bank representative testimony was that the bank had zero problems with the deals they did with Trump and they profited.

As noted…Engomoron stipulated that just because the banks were “happy” (his word) that didn’t mean NY’s statute was not violated in his opinion.

Yes, you’re dishonest. Engoron’s order is not hard to find. I encourage folks to pull it up and read page 22. I think most folks already appreciate that much of what you say is disingenuous at best and at worse . . . well . . . read the order and see how it squares with Lane’s characterization.
