Not really. Obamacare was interpreted as not being constitutional for quite a while. Popular view was it was against the constitution. The Roberts court came up with a novel argument to let it stay in.

Now, this Administration is grabbing people with legal status and putting them on planes denying due process and the checks and balances found in the Constitution.
I do have a problem with no due process, even if I don't agree that the current allowance for multiple appeals etc. and the demand for more time as a legal tactic is necessarily a constitutional protection. If you violate your visa, you should have whatever protection is required to prove you violated it that the law requires.

It is tyrannical. It is wrong. Those who support it, argue for it are not conservatives.

He is doing none of those things,

He has demonstrated that his regime will ignore the 4 corners of the Constitution.

He will ignore mandated due process.

He will ignore the Che k and balance of an independent judiciary.

His unilateral tariffs violate the Constitution and historical precedent.

His Sec team has put us at risk.

You are not this stupid. You are just a bad person and a hack.

You are missing the point.

Legal scholars and public opinion at the time this was passed felt it was a massive overreach and that putting fines on people who didn't buy insurance was unconstitutional.

The democrats did it anyway.

Roberts decided that it was a tax and got a majority of the court to agree even though that was NOT the argument advanced in court. In the legislation, it was stated it was a fine.

The point being that both parties will throw crap up at the wall and insist that the judges are being "activist" and don't accept it until SCOTUS has spoken.

I am not arguing that it isn't popular. I'm not arguing that it isn't the rule of the land. We were challenged that this is a uniquely Trump behavior, which it is not. The level and breadth of it is certainly more under Trump. Its certainly more naked use of it under Trump (or is it that the media is more willing to point it out under Trump?) but its hardly novel.
