Yea - an indictment, and a trial date - coincidences like that seems to happen way too often. Roll Eyes

Oh yea, there's other coincidences that didn't happen but was requested. The one where Trump lawyers asked for a trial date sometime in 2026.

Another is where they are trying to get the RICO case in GA transferred to fed court jurisdiction.

Hummm -- wonder if that has anything to do with the election and potential pardon, or just simply quashing it all fascist style?

She said that each of the trials would last from four to six weeks, raising the threat of overlapping schedules.

Habba, who acts as general counsel for the Trump-supporting political fundraising group Save America PAC, claimed that the possibility of extending the trials right up to election day, 5 November, next year, was “by design”.

She claimed, without providing evidence, that Fani Willis, the district attorney of Fulton county in Georgia who is leading the prosecution of Trump over his attempts to overturn the 2020 election result in Georgia, and Jack Smith, the special counsel who has spearheaded the two federal indictments, were engaged in a “coordinated effort” with partisan motive.

“We know this is intentional – it’s to tie [Trump] up, it’s definitely political,” Habba said.

Yea, I can see your point of view - all these trials are getting in the way of a criminal enterprise and a political movement to flip the system to fascism.

Darn Rule of Law - Trump can fix that too.

Who would have predicted that a campaign for POTUS would hinge on the premise of voting to grant a candidate the power to flip the system to fascism - or not?

Trump's Key Defenses in Jan. 6 Case Could Backfire: Legal Analyst

In a column for CNN on Monday, Lubet, a professor emeritus at the Northwestern University Pritzker School of Law, wrote that the case against Trump hinges on whether or not he spread falsehoods about the 2020 election while knowing that they were not true, noting that the indictment uses the phrase "knowingly false" 32 times and describes around 100 allegedly false claims that Trump made. His main defenses, Lubet wrote, would either be to claim that he genuinely believed the things he was saying or to claim that he was led on by bad advice from his lawyers.

Once in court, Lubet continued, these tactics could very easily backfire. If he were to insist that he believed the claims he made and testify as such as a witness, he would waive his own Fifth Amendment rights and potentially open himself up to being grilled on his many alleged, disputed statements.

"The result would likely be devastating," Lubet wrote. "At a minimum, Trump would be questioned about every false statement alleged in the indictment. If he denied making the claims, there would almost certainly be prosecution witnesses to contradict him. If he maintained that his statements were all true, there will be a mountain of evidence to contradict that. And if he continued to insist that he believed everything he said—about 'alternate' electors, finding 11,780 votes in Georgia, and Mike Pence's authority to reject electoral votes—his cascade of denials would soon become self-evidently implausible."

Furthermore, if Trump were to try and claim that he had been given bad counsel by his legal team, known as the "advice of counsel" defense, it would void attorney-client privilege and would prevent the likes of Rudy Giuliani or John Eastman from claiming confidentiality to avoid testifying about their alleged involvement, the legal analyst added.

"The lawyers, some of whom have been identified as unindicted co-conspirators, could assert the Fifth Amendment for themselves, but that would just undermine Trump's defense," Lubet wrote. "Moreover, the privilege waiver would also apply to any of the lawyers who confidentially told Trump he had lost the election, making them available to testify against him even over his objection."

In a statement to Newsweek, a spokesperson for Trump dismissed Lubet's argument and his standing as an expert.

"This unhinged Democrat donor and Biden supporter has no idea what he's talking about and nobody should be taking any legal advice from someone who is clearly compromised," the statement read. "President Trump will not be deterred, he will fight these hoaxes at every turn, and will win for the American people."

Alina Habba sat down with Fox News on Sunday and claimed – without proof – Trump's busy legal calendar is actually "very much a coordinated effort" to "tie him up."

"Think about how [Georgia District Attorney Fani Willis] when she was asked at her press conference if she was coordinating with [special counsel] Jack Smith in DC and the government couldn't give us a yes or no," Habba argued. "That says it all."

Habba, a longtime Trump loyalist, called on both Willis and Smith to be investigated, arguing that they "intentionally waited" to bring charges for Trump to be leading in the Republican primaries.

When asked about her strategies for prepping her client for the trial, Habba said there's no need for any as Trump, who currently faces 91 felony charges in four criminal indictments, is "incredibly intelligent, and he knows the ropes."

"What is going to have to be prepped for? The truth?" she exclaimed. "You don't have to prep much when you've done nothing wrong. So, that I'm not concerned with."

Given the significance of the issue, I do question the need to delay the trial to just before the elections.

They should be sooner than that.

If I was a judge, my response to Trump would be that I’m fine with your requests to delay the trial to after the election… but the condition to do so is you NOT run for office until the matter is settled. You get a choice - timely trial within 3 months or delay and actually concentrate on developing your defense.

Your choice.

That's been Trump's go-to for legal matters for decades, always delay and try to make the other guy give up and settle for peanuts. Contractors, banks, wives.

Problem is the opponent this time is the United States and the charges are criminal. He has a lot of Finding Out coming his way.
