That said 1500 people did not beat up cops. I think those who did should do a lot of time and should not have gotten pardoned. I also think a lot of people were over prosecuted for their stupidity.

It's also my understanding that there were people who never entered the building were hunted down and prosecuted. Their homes were damaged by door kickers, etc to arrest them for simply being at the event. This was not right at all. Bad things happened that should not have. The fact is, there were paid informants and instigators placed by the FBI to geek things up. WRONG thing to do.

All this means the rest of us will never know the real truth. Pretty awful what some will do to cause problems. Even worse when it comes from the law enforcement side.

After Heym and I asked you to specify what due process you mean, you hide behind someone's extraneous comment that the committee may not have allowed cross-examination.

But the J6 defendants were never and could not have been charged by the Congressional committee.

If you're now abandoning the position that the J6 defendants didn't get due process, man up and say so.

Actually, we are looking at all the election data for the last 50 years to plot the graphs. Now we have a data point after 2020 that “mysteriously” fell back into the normal trends. Stick your head in the sand if you want to…but the data highlights 2020 as an anomaly.

The anomaly was that the losing party did not accept the results of the election, failed to prove their case in a court of law and resorted to trying to steal the election through any means possible including violence. That was an anomaly I hope to never see again.

You can keep repeating the big lie all you want, but I know what I saw. Trump is a rotten son of a bitch, who tried to steal the 2020 election. Plain and simple.

This is what I believe: I believe there was major injustice in the 2020 election cycle. I believe many good people were outraged by it. I believe some made poor choices. I believe the heavy hand of the federal prosecutorial system with unlimited resources abused its power in the majority of the cases. While definitely a handful of the convicted probably needed to stay in jail…many if not most didn’t. Did they make mistakes? Yes. Don’t we all…???

So yes Scott, in the context of the 2020 saga along with the history of how this pardoning system has worked, I am “OK” with the President pardoning these folks. I will conclude with I have never advocated for jailing anyone in politics — not Hillary or anyone else.

The thing is, I'm not someone that you are going to be able to redefine reality for. I watched the attack on our Capital happen, I heard Trump try to pressure Raffensperger to "find" the votes he needed, I know about the fake electors that Trump dispatched to congress, all in an attempt to steal an election that he lost.

You are lying, just like Trump is lying about the 2020 election. I'm happy to call you out for your behavior online or in person. I'm not bashful Cool Big Grin

The courts pretty much said that there was nothing they could do with regards to the 2020 election after the fact.

The procedures put in place were followed to the level of the law. There is no statutory language about what to do if after the fact you can find some anomaly but cannot point to a specific person’s wrongdoing. That’s what this “due process” discussion is avoiding.

The whole disparate impact analysis thing that is going on in some civil cases is an attempt to get around that- and most of the folks on the right really disagree with disparate impact analysis in courts.

In this situation, the right got caught in a situation where there was no legal remedy and given all the privacy protections, no way of identifying specific wrongdoing.

The guys on 1/6 who got arrested for trespassing were kind of railroaded. The guys who were convicted of violence, sedition, or obstruction did not deserve pardon.

The trespassers getting pardoned and the guys getting pardoned for obstructing government proceedings are a bad precedent.

Trump and Biden’s wholesale pardons are not a good thing.

Trump’s at least have some historical precedent- Washington and post civil war a lot of pardons were issued in the name of settling a political disagreement.

We are now seeing why Ford’s preemptive pardon of Nixon was a bad idea. While I think a simple majority agreed with it at the time, a simple majority don’t agree with what Biden did.

While I am good with seeing where Trump goes with things, I don’t think his pardoning all the 1/6 types was a good idea- even if he said he was going to do it and he won election with that being part of his baggage.

Most courts said Trump did not even state facts that made a claim of fraud.

A few courts found as a matter of law voting procedures were valid.

Your characterization of the courts involvement w the election is inaccurate.

As far as pardons go, it is his sole, vested power. He did it.

Exactly. All these efforts to spin the events to be something it wasn’t . . . I watched what happened live on television. Not edited clips weeks later. Live. I saw the mob fighting with law enforcement. I saw the destruction taking place. I saw Congressmen in the chamber barricading the doors with a mob trying to break down the doors. Trying to portray it as some peaceful protest, unruly tourists . . . that might work with someone that did not see it live but it will never work with someone that watched it live. That’s what makes the pardons so reprehensible in my mind. And please do not bore me with deflections by references to BLM and other riots. One, I am fine arresting every last one of the rioters regardless of the riot. Two, what happened on January 6 happened in our Capitol, the People’s house, on the day a Constitutional step in the peaceful transfer of power was supposed to take place. Every one of those rioters and their enablers deserves a bed in a jail cell in my mind.

With the time-lines involved…suits will never be a viable mechanism to deal with potential fraud violations in our Presidential election. As every attorney here will admit if honest…it takes 6 months to a year to prepare for a case like that. Discovery alone likely to take year. The case would likely take longer than a presidential term.

I may misremember… but I thought they said that the evidence Trump presented was not admissible. Therefore he had no evidence.

They stated that statistical arguments were not evidence. That sudden swings in the vote talley were not evidence.

Trump was unable to present evidence that the vote was inaccurately counted… because it was not.

Due process was used and the Trump side could not present any admissible evidence. Trump then tried to get the court to allow discovery so they could find evidence and was turned down.

Then team Trump started grifting saying that if we gave them just a few million more they would find all this evidence…

No, it never got to an evidentiary hearing on admissibility.

Federal Pleadings standards require the pleadings to be pled w specificity, facts.

Most of the Fed cases were dismissed because this standard was not met in pleadings.

Trump technically did not state a claim.

Bell Atlantic Corp. v. Twombly,
Ashcroft v. Iqbal

Pennsylvania Supreme Court specifically ruled voting procedures were legally valid.

Trump’s at least have some historical precedent- Washington and post civil war a lot of pardons were issued in the name of settling a political disagreement.

We are now seeing why Ford’s preemptive pardon of Nixon was a bad idea. While I think a simple majority agreed with it at the time, a simple majority don’t agree with what Biden did.

While I am good with seeing where Trump goes with things, I don’t think his pardoning all the 1/6 types was a good idea- even if he said he was going to do it and he won election with that being part of his baggage.


Agreed with this 100%._ logic does make sense.....

This is what I believe: I believe there was major injustice in the 2020 election cycle. I believe many good people were outraged by it. I believe some made poor choices. I believe the heavy hand of the federal prosecutorial system with unlimited resources abused its power in the majority of the cases. While definitely a handful of the convicted probably needed to stay in jail…many if not most didn’t. Did they make mistakes? Yes. Don’t we all…???

So yes Scott, in the context of the 2020 saga along with the history of how this pardoning system has worked, I am “OK” with the President pardoning these folks. I will conclude with I have never advocated for jailing anyone in politics — not Hillary or anyone else.


And so Hakeem Jefferies says what he does. You advocate for, give license to and set precedent for political violent speech and actions.

BLM and Antifa are ok! If the Taliban storm the Capitol its fine! It's just political and no one in politics needs jailing.
