I really don't understand the thought process on the pistol brace ban.

Is there any statistical evidence that SBR's are used in the commission of crimes at a higher rate than other weapons?

I have no issue w a brace. I think you should have to present a medical certificate of need to purchase them, and used as a brace handgun.


That is what the brace was designed for originally. To allow those who could not support a rifle to get to use these firearms.

Or, everyone has to be used as a brace as designed.

Before anyone starts the fallacy that how one uses something should not make the crime, I submit you look at assault “dangerous weapon” caselaw. That can be almost any item, and is in most cases a fact question for the jury to decide.

Now, the argument is brace or mounting to shoulder does not make it more lethal. I agree w that. The issue is not lethality, but compliance with the NFA not to possess or transfer a SBR not in compliance with the NFA which is constitutional.

Again, I have seen no statistical connection between short barreled rifles, brace or not, and crime. Most firearm offenses involve handguns. I don't see the need for the regulation. And, if the government is going to abridge a constitutional right, there ought to be a good reason.

I am willing to assume there is not one. The idea of adding Sawed soft Shotguns and SBRs to the NFA was the concealability.

The NFA specifically was twice held Constitutional. Justice Scalia determined that those decisions did not need to be distributed bc they dealt w weapons not in common use. In common use is a perquisite for the regulation to be subject to McDonald.

The first drafts of the NFA included handguns.

Point is the legislative scheme concerning SBRs in the NFA is constitutional. The use of a firearm as an SBR requires the NFA for possession and transfer to be complied with.

The GOP on 2016-2028 could have advanced a bill removing SBRs or excluding braced firearms. They did not. In fact, the GOP never got a bill to remove suppressors to the House Floor.
