Does anyone know the status on the scimitar oryx, addax, and dama gazelle? I see they're still listed on various hunting websites, so did the legislation to close hunting those species fail?

Evidently Sevens, they are still being hunted. I still have one TX Outfitter that lists all 3.

I do know that a lot of ranchers have discounted their Scimitar Horned Oryx hunts here.

Here is the latest update from EWA:

"EXOTIC WILDLIFE ASSOCIATION MEMBERSHIP ALERT
In keeping with the EWA’s pledge to keep our members informed on the latest regarding the three species the following is the most up to date information I have for our membership:
On Tuesday May 18, 2010 the U.S. Court of Appeals for the D.C. Circuit in Washington D.C. summarily dismissed EWA’s appeal, which means that Judge Kennedy’s decision will stay in place unchallenged. But importantly, the D.C. Circuit dismissed EWA’s appeal on the ground that the district court’s ruling was not a final decision. This confirms that the challenged rule is still in effect until the USFWS revokes the rule. You should also understand that the D.C. Circuit did not rule on the merits of this dispute. Rather, this was simply a procedural ruling reflecting primarily the fact that the government itself pulled out of the appeal. In short, this ruling reflects the administration’s changed litigation policy.
Where does this leave the status of the three species? At the moment the rule is still in place but we believe that this could change very fast. In the semi-annual regulatory agenda, USFWS stated that they plan to revoke the rule. They are not required to follow through with this, however, and this process should normally take 6-8 months to complete. During this process they may develop a permitting system for these three species that will comply with court requirements. That will also take time. Or, as stated in their April 26, 2010 regulatory agenda, USFWS published a notice indicating that they may simply revoke the rule. In short, what they intend to do about publishing a new rule is unclear.
Is that the final nail in the coffin? Not by a long shot. EWA’s attorney’s are busy, at the very hour, working very closely with SCI’s litigation team on a multi-prong strategy that could be very beneficial for the animals. In addition our lobbyists as well as representatives from the Congressional Sportsman’s Caucus are working very hard to find the best avenue of approach in this situation. Not a single person on our litigation or lobbying team has thrown in the towel—so neither should you.
Your EWA Board of Directors will be meeting Friday, May 21 to determine what future course of action we will take. We will present you with several actions, but they must all be acted on immediately because of the threat that FWS may simply issue a final rule revoking the exemption, without notice and comment.
I know there will be many rumors and questions as a result of this alert so the following is what we know at this time in regards to buying, selling, trading and hunting any of the three species

As of this moment nothing has changed regarding the rule. We are still operating under the 2005 USFWS rule which exempts these three species
from the permitting process. The management of these animals through hunting is still allowed at this point. ( This could change at any time).

There is no permitting process established for these three species so please do not call the USFWS asking for permitting forms. This is very important.

Please do not call the USFWS asking about any future plans because they do not know themselves at this point what they are going to do.

Please do not fall prey to the multitude of rumors that will be flowing throughout our industry regarding false deadlines or doomed outcomes that no one can know at this time. If you have any questions regarding this decision please contact me at the EWA office or by cell phone at 830-928-3158. "A death warrant has been issued on several exotic species, and EWA needs your support to save these magnificent animals and preserve private property rights. Three antelope species —the Scimitar-Horned Oryx, Dama Gazelle and Addax — were the subject of special rules that were adopted by the U.S. Fish and Wildlife Service on September 2, 2005. Although these three animals are classified as an endangered species, these special rules made it possible for owners of captive herds to continue to engage in activities including the purchase and sales of the animals. The special rules effectively made it possible for ranchers to breed and freely trade these animals on ranches across the United States without the USFWD permitting process. In fact, the program has been so widely successful that it now fuels a $1.3 billion industry and thousands of jobs mostly in rural America. The Scimitar-Horned Oryx is a perfect example. Currently, there are thousands of these amazing animals living on preserves and ranches. The Exotic Wildlife Association has established a partnership with the renowned Sahara Conservation Fund and the two groups are working to reintroduce the species back into their native countries. The success of the game ranches in breeding rare and endangered species, like the Scimitar-Horned Oryx, is an example of how private conservation can affect the worldwide preservation of such animals. Many endangered species are virtually extinct in their native lands, but are flourishing in the United States because ranchers are able to freely buy, sell and breed the animals.
However, three years ago, the Humane Society of the United States (HSUS) filed a lawsuit to stop the special rules and the EWA and Safari Club International has fought the lawsuit ever since. In July 2009, a Federal judge ruled that the three species which are born and raised in the United States will not be exempted from their listing on the endangered species list. As a result, ranchers who have owned and cared for these animals for years will be required to cease all breeding, transport, hunting or other management activities unless special permits are obtained. If this ruling stands these three species will cease to have any value to breeders and could become extinct worldwide. The ability to raise these animals for breeding or hunting purposes gave these animals a real intrinsic value. In their native countries, these animals had no value and people did not care whether they became extinct. But members of EWA, ADWA, SCI and others do care. Ranchers and hunters brought these animals back from the brink of annihilation because the special rules exception gave these animals value. Without it, no one will invest in the animals’ future. They will die and the anti’s that started it all will just sit, watch and applaud their ‘noble’ deeds. But in the end, what is the more heinous crime — allowing exotic animals to be bred, to grow in population and to eventually be managed through responsible culling, or to orchestrate a legal situation that leads to a planet-wide extinction and the species are lost forever? The Exotic Wildlife Association urges all sportsmen, hunters and wildlife enthusiasts to contact their federal representative and U.S. Fish & Wildlife Service to voice their support for saving these magnificent animals.
