This is what happened:

In June, 2002 I traded a Browning BPS .410 for a Charles Daly O/U Field hunter 3" to do some skeet shooting.....I wanted the O/U because I just like the twin tubes.

After less than two weeks shooting skeet.....less than 150 rounds of ammo the Chrome lining came out of the end of the lower barrel. I noticed it curling up and just continued to shoot it because there was nothing I could do about it anyway. The lining must have been pretty heavy because it caused the lower barrel to be about .020 OS and the full choke now was converted to a cylinder bore and the pattern was large enough to cover a four foot circle at 20 yards.

I returned it to Daly (now KBI) with the original receipt and explained that the choke was bad in the lower barrel
They replied that I didn't give them any receipt to account for time of purchase because they was not honoring Daly warranties prior to KBI taking them over. I replied that the receipt was in the box and they looked and agreed it was and that they would honor the warranty.

Today...two months later The gun is returned with the following message....(word for word)

We have found the lower barrel has been modified. Someone has removed the chrome lining at the muzzle end of this barrel. It is not a defect in workmanship and is not covered under warranty. Additionally the modification is beyond any practical repair. We are returning the shotgun to you. Please note the selling price listed on the receipt is less than half the normal new selling price for this model. (it was the trade in price)

I called KBI to ask what the deal was and they're holding firm to the assumption that the gun was "modified" whick is pure BS!!! Essentially they're refusing to warranty their product.....

It is my intention to give Charles Daly (and KBI) all the deserved advertizing I can.......

That sucks, I've been looking at one of thier cheap O/U's they sell at WallyWorld (not much interest in highend shotguns for me). I guess I'll stick with my 870 a few more years.

Thanks for the heads up on this company!

I contacted KBI about a replacement barrel for a .45 pistol they sold which had it's barrel lug CRACK! They replied that they would not sell the relacement part, I could only have the pistol repaired by their gunsmith. The price for this service was more than the sale price of the whole pistol. They could not even guess at a turnaround time. An email from their gunsmith stated that it the work would be done at his personal shop when he found the time.

The pistol now sits broken as a reminder to NOT DO BUSINESS WITH KBI (CHARLES DALY).

"modified"...
okay.. I would ask "just what tool was used to modify this barrel " and on the purchase price, I would simply state to them that even apple gets sued for TRYING TO "FIX" PRICES.

Of course, that letter would be on my lawyer's letterhead, as this is a second pass at attempting them to honor THEIR warranty.

In most states every company that wishes to do business in that state must have a registration with the secretary of state that indicates who the company's contact is to receive service of process in that state. Most of the time it will be a company that provides that service.

I would call KBI, ask who receives service of process for them in your state, and then go ahead and file a small claims suit for the amount of damages you believe you have suffered.

If KBI will not tell you who receives service of process for them, inquire from your secratary of states' office if KBI has in fact registered a process receiver. If not, complain to the secretary of states' office that KBI has not registered to receive service within your state. It might be possible that the office would then write a letter to the company indicating that if they did not register they would no longer be allowed to conduct buisness in your state.

More than likely, if served, KBI's legal dept. (or outside counsel) will advise the company to settle if the amount is low enough because it would cost more to send an attorney to defend the suit. (make sure and provide sufficient detail in the pleadings)
