My dad purchased a Colt Army 45 through the NRA way back in 1962 when he was stationed in Maryland.What process is needed to register it in NY.Any help greatly appreciated. | ||

You will have to apply for a New York State pistol permit, which is approved (or not, as he sees fit!!) by the County Judge. As mentioned above, your county's Sheriff's Department probably handles the applications (Unless you are inside the City of NY, in which case it is the City Police Commissioner. The laws are much more stringent inside NYC, and damn few people ever get a permit there! The mere possession of a handgun without this permit is a crime under NYS law. Even if it is in your home! It would be a FELONY in the City!! In other words, to legally obtain a handgun in NY State, you have to get the permit FIRST, then obtain the gun. After you have the permit, and have obtained the gun legally under the permit, you have to take the pistol to the Sheriff's Department, and have it "put on" your permit. This consists of listing the pistol by SN, caliber, make, type, and caliber on your permit, AND making a permanent record of the gun being in your possession which is retained by the Sheriff. After you have gone through all this B.S., if you decide to dispose of the gun later, it can only LEGALLY be sold to another pistol permit holder, or to a licensed dealer. If you do dispose of a handgun, then you have to go to the Sheriff's office once again, and have the gun "taken off" your permit and deleted from the Sheriff's records. However, once you have the permit, you can put as many pistols on it as you want. But the County Judge has to issue you permission to buy each and every one of them, IF PURCHASED FROM A DEALER. It takes at least 6 months to get the pistol permit after yoiu have submitted the application, as they go through the drill of a criminal records check through NCIS AND they send a complete set of your fingerprints to the FBI for what's called a National Agency Check to see if you've ever been arrested by anyone anywhere for anything! The Sheriff will charge you what I consider to be an exhorbitant amount for this FBI check, (this varies from County to County),and every time you add a gun to your permit or delete one, the Sheriff will charge you a nominal fee - like $5.00 or $10.00. If you are a friend or a political supporter of your local District Attorney, and already have your pistol in the State of NY, MAYBE they won't arrest you if they ever find out you've got the gun in the State already! Of course, if you have the pistol some place outside the state, then you can have it sent to you via a licensed dealer, AFTER you get the permit. This would keep you out of trouble. My advice would be to get the hell out of NYC and take your .45 with you. I wouldn't put up with all the BS to own a handgun. I've not finished dressing until one of my .45's is holstered. A shot not taken is always a miss | |||

If you have held that .45 in NY without registration for XX number of years, you are probabaly in deepest kimchee with any Sheriff in the state. Get that gun OUT OF NEW YORK, then start the procedure for returning it via the 6 month wait for a license, etc... BUT GET IT OUT OF NEW YORK!! LLS as a many years NY Licensee, including going thru the out and back in evolution. All can be Hell!! ![]() | |||

Maybe I am just thick headed, but I wouldn't live in a state that expects you to get a permit to own a handgun. New York is so stupid that it requires you to have guns in plain sight when going through the state so their criminals can steal them. I've been in Manhattan and have visited other parts of the state. Good folks. Too bad the government sucks. RELOAD - ITS FUN! | |||

You have a valid point here, BUT we have to be on our toes all the time to keep this kind of stuff from happeneing in other states as well - BTW, NY is NOT the only place that makes life hell for pistol owners!!
