We've just heard one side of the story, but it seems like the Court erred badly. There has to be a showing of intent to commit a crime before a conviction is valid, which means the defendant had to know the rifle would fire full auto. On the other hand, if the defendant did know that the rifle was defective and apt to go full auto at the time he loaned the defective rifle, he might be guilty. You'd have to be on the jury and hear all the evidence before you could really have an informed opinion. | |||

In an ideal world, that is true. However, that was not the case here. Unfortunately, there are more crimes on the books today that do not require a finding of criminal intent - just the act specified in a law is enough to meet the prosecution's burden. And that is one of the troublesome aspects of this case. Intent did not matter.
