Surplus military firearms are prohibited from importation under 18 U.S.C. § 925(d)(3); however, § 925(e) authorizes licensed importers (FFL type 08 or 11) to import surplus military rifles and shotguns classified as curios or relics; and handguns classified as curios or relics which meet the sporting criteria. Further, under the AECA, the importation of U.S.-origin surplus military firearms is generally prohibited without retransfer authorization from the Department of State. 27 CFR § 447.57.


What that does not tell you is that once a former military gun has been sporterized and then sent to a commercial proof house it is then considered a commercial rifle. I had several military 98's retailed by British makers which carry commercial proofs approved it the last week.


Additionally, that easily could be a commercial action. Tons of original Oberndorf sporters look identical to military actions, yet carry commercial proofs.

Commercial thumb cut rifles are imported on a regular basis. One of the members here regularly brings in Husqvarna commercial riles.

There are several companies bringing European guns in, BY THE CONTAINER LOAD, all of the Mauser's which have a thumb cut.
