How does a felon who’s married to an immigrant get away with deporting immigrants by declaring them to be felons?

I hear it often from Rightists that undocumented or so-called illegal immigrants are criminals just for their presence here.

And they should be treated like criminals.

They say that just because such criminals claim they snuck across the border fair and square doesn't entitle them to due process of OUR laws.

Question: are illegal immigrants felons?

No, being an undocumented immigrant in itself is not a felony. While illegal entry into the U.S. is a federal crime, it is not automatically a felony. It is a misdemeanor for the first offense, but a felony for subsequent offenses. Additionally, undocumented immigrants can be convicted of felonies for other crimes, just like any other individual.

Here's a more detailed explanation:
Illegal Entry: Entering the U.S. without proper authorization or documentation is a violation of federal law. It is classified as a misdemeanor for the first offense and a felony for subsequent offenses.

Undocumented Presence: Being present in the U.S. without legal permission is not a felony, but it is a civil offense. However, unauthorized presence can become a criminal matter if an individual has previously been deported and re-enters the country illegally, or if they are convicted of other crimes.

Criminal Aliens: The term "criminal alien" is typically used by the government to refer to non-citizens who have been convicted of a crime. This includes both those who entered the country legally and those who entered without authorization.

Felony Convictions: Undocumented immigrants, like any other individual, can be convicted of felonies for various crimes, such as drug offenses, theft, or violence. A felony conviction can lead to deportation, even for those who have legal status in the U.S.

Research on Crime Rates:
Research suggests that undocumented immigrants have lower crime rates than both native-born citizens and legal immigrants. This is likely due to factors like a strong motivation to avoid actions that could lead to deportation and a selection effect where immigrants who come to the U.S. may be more ambitious and less likely to commit crimes.
