The high court spoke. The discretion rest in Federal Government. It does not rest and the state cannot enforce. The state tried. The S. Ct., threw them out.
What you are complaining about is the same.

Texas wanted the feds to enforce fed law, when didn't Texas did
Let's out to a federal crime
Bank robbing or kidnapping
The feds and the States have laws against it, no complaints
The feds don't enforce immigration, the state does, complaints
But your point isn't as solid as you think, as the courts didn't give it all the feds way.
