The reason motion for directed verdict are typically overruled is because the Judge has to, by law, draw all reasonable inferences in favor of the non moving Plaintiff. This is a motion for mistrial alleging the Judge has manifested bias against the Defendant by warning him his tweets are inappropriate and may subject him to contempt. This would be exactly correct. And, there might be a variety of reasons to file a Motion for Mistrial (which is different than a Motion for Directed Verdict) but a Motion for Mistrial because the judge is ruling against you on evidentiary issues is not done. At least in my experience. It's specious, unprofessional and probably unethical unless the court's rulings are really unusual and insupportable. -Every damn thing is your own fault if you are any good. | |||
