Steve BertramWhat was the emergency used to justify tariffs? A trade deficit I believe. How do you then rationalize the tariffs applied to those that have a trade surplus with us such as the UK, UAE, Brazil, Australia and others? You can't.
I will submit that there never was an emergency.

I think the basics, that there's no "emergency " i agree.
That is the only way/arguement I can imagine that can stop this. Arguing the niceties post-declaration , is the losing side. Stop it at its source, not the frills.
The tariffs are stupid. This arguement is likely to lose, though, as they are treating symptoms not the root (cause) of the power.

jdollarTrump is quite used to losing in court. He’s spent tens of millions on lawyers in the past few decades doing exactly that. Nothing new here except now it’s tax payer money he’s pissing away. So much winning!!

theback40I just noticed the tariffs last week.
Putting on a steel roof. The screws that usually come out of Canada, almost doubled in price from a week ago.
The lumber yard just sourced them from elsewhere for a normal price.
I felt bad for Canada, loosing a sale. They are my neighbor and I support them. Unfortunately, my thrifty yankee blood means I went with the cheaper option.

Emergency or not, the Fed Law did not give him the power to unilaterally impose tariffs.
Congress cannot delegate through mere legislation its Article II power to any president either.
A president does not have the constitutional power to impose tariffs; even by treaty, the Stnate would have to ratify it.
