Only if the S. Ct., creates a new rule.

He should not, but you are not really a conservative. You would not give a Dem this power that is denied to the President by the Constitution.

The only way he wins is the Court ruled the question is non-justiciable question.

Maybe, through standing he might convince 5.

However, the court delayed the impact of its decision through mid-October to allow the Trump administration to appeal to the Supreme Court, as the tariffs remain in effect.

The statute is SILENT on the word tariff, but grants sweeping economic powers to potus -

and in no way shame or form would I ever recommend "pick up a rifle" as some officers of the courts have

What was the emergency used to justify tariffs? A trade deficit I believe. How do you then rationalize the tariffs applied to those that have a trade surplus with us such as the UK, UAE, Brazil, Australia and others? You can't.

I will submit that there never was an emergency.

Steve,
I think the basics, that there's no "emergency " i agree.

That is the only way/arguement I can imagine that can stop this. Arguing the niceties post-declaration , is the losing side. Stop it at its source, not the frills.

The tariffs are stupid. This arguement is likely to lose, though, as they are treating symptoms not the root (cause) of the power.

Trump is quite used to losing in court. He’s spent tens of millions on lawyers in the past few decades doing exactly that. Nothing new here except now it’s tax payer money he’s pissing away. So much winning!! rotflmo animal

I just noticed the tariffs last week.
Putting on a steel roof. The screws that usually come out of Canada, almost doubled in price from a week ago.
The lumber yard just sourced them from elsewhere for a normal price.
I felt bad for Canada, loosing a sale. They are my neighbor and I support them. Unfortunately, my thrifty yankee blood means I went with the cheaper option.

Emergency or not, the Fed Law did not give him the power to unilaterally impose tariffs.

Congress cannot delegate through mere legislation its Article II power to any president either.

A president does not have the constitutional power to impose tariffs; even by treaty, the Stnate would have to ratify it.

I admit I like Trump despite his shortcomings but then all his predecessors had as many and maybe more than him. After all it’s human nature
His way of rattling opposition is rather good way of showing their colors
He is definitely a lot smarter than people giving him credit

He might given the current make-up of the SCOTUS.

But, legally, based on precedent at least, it's not even close that he loses. His emergency argument is bullshit.

Don’t waste your time. The question has been answered for Milan at least three times. Not sure if he is pretending to be obtuse or is in fact obtuse. Some countries have VAT too. Maybe we should too . . . after all if they like it maybe we would as well.
