I have worked (and I mean WORKED) in 100+ temperatures, for extended periods. We took a ten minute break every couple of hours and an hour for lunch. Hydration was a problem, simply because one's body can't absorb the water fast enough. Had a foreman complained about me taking time to drink, I would have beat him down then quit. To me, the requirement for ten minutes in FOUR hours is more than reasonable and I can't imagine an employer balking at this. Of course, the mindset of companies using undocumented workers may be a little different. There is more to the bill than mandated water breaks, and this may just be a collateral damage sort of thing. For workers who are denied water while working in extreme temps, I would suggest that a piece of re-bar, applied to the foreman's kneecaps might prove efficacious in changing his approach. Southwestern Bell Telephone would not order trucks with air conditioning. I put a thermometer in my truck and kept a record of the temperature for the summer. Sent it to OSHA and the response I got was "Can you roll your window down". Yeah I can but the newer trucks just blew hot air from the vents. We were driving from Wichita Falls to Childress and back every day. We would be wringing wet by the time we got home. You think OSHA under a democrat would have helped us out. | |||

There has to be an Administrative Regulation for OSHA to enforce. Was such a reg in place at the time? Again, folks wonder how labor unions and collective bargaining became a thing. I know when President Obama was in office OSHA was citing employers for non working air conditioners in trucks. It is not the lack of air conditioning that caused the violation. It is the heat, with no sage means to remedy. The Federal Motor Carrier Safety Regulations (FMCSRs) do not require a commercial motor vehicle be equipped with AC. It is not listed as one of the required parts and accessories in 49 CFR Part 393. Therefore, it is not a violation of the FMCSRs if a vehicle is not equipped with AC, nor is it a violation if the AC is not functioning. However, the Occupational Safety and Health Administration’s (OSHA) General Duty Clause (GDC) requires employers to protect employees from recognized, serious hazards, regardless of whether there is a specific standard addressing that hazard. https://www.osha.gov/ords/imis...229.015&cit_id=01001 I am all for amending the Fed Act to require AC in all Commercial Vehicles. | |||

I don't think anybody working on a outside jobsite in Texas is being deprived of water due to employer policies unless the employer is a fucking idiot, regardless of the laws and policies on water breaks. When you got workers on a roof in Texas in the summer, you make sure they have a shitload of water or you aren't going to have any workers because they're going to collapse. Which is not a good business practice. 112 heat index here today. But, there may be idiot employers out there who need some motivation in terms of the law to make sure it happens. -Every damn thing is your own fault if you are any good. | |||

An auto salvage yard operator near me was a hard right winger with no use for any damn Mexicans. His politics went out the window when he took bids for a big new shop building. It’s not just “third generation”. Cesar Chavez was against “wet backs”. In one of his more controversial moments he was tied to a ln armed group who was defending the border from illegal immigrants. Illegal immigration is bad for legal immigrants as they devalue their labor, and it is also bad for the illegal immigrants themselves as they are exploited as a matter of course. But illegal immigration does make shareholders more money… so I guess it is good for someone.
