Special District will not elect Judges, Prosecutors Login/Join

Mississippi elects Judicial and prosecutors.


The one exception is a new special district inside Jackson. In this new District residents will not elect the Prosecutor, the Judge, the Court Clerk.

This is why claims of institutional racism and voter suppression dog the GOP and Southern Legislators. They give the opposition the bullets to shoot at them.

Ask yourself, Why is this new special district being created? If your answer is because Jackson is too black and carry too much weight in the Elections, then you have made my point.

I don't like the idea of elected judges, and especially not district attorneys (prosecutors. I don't think the third judicial branch should be subject to politics. Too often, I suspect, the DA's charging decisions are made under the influence of the next election.

As for the GOP and Jackson, maybe a judge will set things right.

The issue is not whether we like elected Judges/Prosecutors.

The issue is the special district by designs maneuvers around the right in Mississippi to have those office elected because African American had too much political voice.

In Mississippi (same as KY) Judges and the big chair prosecutors are elected. This is a run around to break African American voting power.

Now, anyone is free to question or advocate a different means of picking those offices.

However, ALJs in KY are selected by the Governor at recommendation of the Judicial Nominating Committee. My old boss controls that Committee. It is not a “better” less political system. However, that is another debate, and a worthy one.

KY has ethical rules that essentially say a Prosecutor must not try a case when he believes the person is more likely than not innocent. That is the failsafe.

I doubt the Legislature’s actions are going to be overturned. The state Appellate Jurist are all elected, the Legislature can set Judicial Districts. I think we can articulate a Federal Case based on voting rights and representation, but I do not think it gets over.

I just wish the GOP controlled Legislatures would stop doing what the opposition says they will do. I wish they would Show some restraint, and not fall into the trap. They just can’t seem to not load the gun for Dems.

In KY the abortion amendment is a clear example. That is going to be a factor in this Governor’s election.

Instead of nominating AG Cameron. We are going to nominate our on Karie Lake.

I agree with you roland, 100%. But how do we get them? The only other way I'm aware of is political appointments....

Some states appoint Judges the way zKY appoints ALJs. A commission made up of lawyers, some use lawyers and a community at large member to select a panel of 3 to submit to the Gov. The Gov. then picks one of those.

The other way is a hybrid. The Citizens elect, but the Gov. will renew the judgeship or dismiss at the end of the term.

The third way I know is citizen vote within the Circuit/District as defined meets and bounds by the legislature.
