Yep, his attorney is arguing he could only be prosecuted after he was impeached and removed from office, while Trump is arguing in Georgia that prosecuting after impeachment is Double Jeopardy.

Key moments in the arguments over Donald Trump's immunity claims in his election interference case
Appeals court judges are signaling they will likely reject Donald Trump's claims that he is immune from prosecution in his election interference case

When Judge Florence Pan asked Sauer if a president who ordered SEAL Team 6 to assassinate a political rival could be charged, the attorney appeared to equivocate, saying the president would first have to have been impeached and convicted by the Senate in order to be prosecuted.

Trump's "Fifth Avenue" sequel

(excerpt)

Then-candidate Donald Trump famously remarked two weeks before the Iowa caucuses in 2016 that he could "stand in the middle of Fifth Avenue and shoot somebody" and he "wouldn't lose any voters."

On Tuesday, Trump's lawyer suggested in federal court that a president could order SEAL Team Six to assassinate a political rival and — unless he was impeached and convicted by Congress — be immune from criminal prosecution.

Why it matters: The two scenarios are provocative and hyperbolic, but they offer a useful window into the dueling political and legal realities in which Trump is operating.

If he was arguing about ordering the assassination of an enemy of the U. S. that would be a different story. Ordering the murder of a political rival should be grounds for immediate prosecution. The DOJ policy offers only TEMPORARY immunity as a COURTESY to the office. Don't know where he dredges up this idea of permanent immunity from everything and everyone!

He has always thought that of himself. It's an essential part of his toxic narcissistic self-image.

It was in part the reason he ran for POTUS in the first place, and most certainly why he wants the joy sticks again.

That's why when he loses the immunity case it will be the slippery slope in many ways. First to his ego, for which he will try to incite violence if for nothing more than retribution. Then after we all suffer with that for a while, his conviction, and perhaps before that his exclusion from the ballots in all states.

BTW, he's already lost immunity appeals in civil cases.

He used to be a Democrat. https://en.wikipedia.org/wiki/...ions_of_Donald_Trump

He changed party to Republican because it's the only party where his game would stick. Now he owns the party as proof he was correct.

Civil case immunity denied:

Trump's Defamation Lawsuit Takes Another Blow as Appeals Court Rejects Immunity Claim

The Second Circuit U.S. Court of Appeals rejected a request by lawyers for former President Donald Trump for the full court to review whether federal immunity protects him from being sued for defamation by columnist E. Jean Carroll. Last month, the same court denied a request by Trump’s lawyers for a three-month delay to the start of the second defamation lawsuit brought by Carroll. In May, a jury found that Trump had sexually abused Carroll in a department store changing room in the mid-1990s and later defamed her by denying her account of the attack.
