LHeym500Tariffs held unconstitutional
The Regime’s unilateral imposition of Tariffs has been held unconstitutional.
https://apnews.com/article/tru...8e49ad4f64254ae3f94aThis court has the same authority as any district court. It is an Article III court of limited jurisdiction.
"A" court......damn....just damn....
A court in new york found against the Trump administration.... Go figger.......
.
Seems every court and judge is sticking it up the MAGA ARSELE's rear end!

LHeym500You are a fool.
The Executive is trying to exert power the Constitution does not give it. This is a conservative opinion. However, you simply proof you are a fake conservative.
It will be the Supreme Court soon enough.
Oh and this Court has national jurisdiction over these issues. The Regime argued to have all the tariff cases before this court. Read more before you speak, or do not and continue to hold options based on nothing but ignorance.

Three judge panel. One judge appointed by Reagan, one by trump and one by Obama. Unanimous decision.
You go figger.

LHeym500Again, it is the most conservative opinion the Court could render.
Even, the Regime’s lawyers did not argue the President can unilaterally impose tariffs. They argued a war powers act from the 1700s have the president the power to do so. There has never been a court nor an administration that has supported that reading.
Likewise, no administration has unilaterally imposed tariffs. The power rest and is vested with Congress.

Your courts don't correctly interpret and apply your laws and instead do what they feel like on the day?
Maybe you should move to a country where the courts are not political but work like, well courts.

jeffeossoWell, that didnt last long
https://thehill.com/regulation...court-lifts-tariffs/30 May 2025, 01:25
LHeym500Actually, still is.
Many of Trump’s tariffs remain blocked under a separate ruling issued by a federal judge in Washington, D.C., though that judge gave the administration two weeks to appeal before it goes into effect.
He is not winning this one at the S. Ct.
Even the Fed Circuit did not hold the lower court was incorrect, “Temporarily stayed until further notice while this court considers the motions papers.”
So, no.

LHeym500This is from the opinion. It will be nailed to the Regime’s head when it is all said and done.
“The court does not pass upon the wisdom or likely effectiveness of the President’s use of tariffs as leverage,” wrote the three-judge panel. “That use is impermissible not because it is unwise or ineffective, but because [IEEPA] does not allow it.”

Yes, there are other cases pending, however, THIS judgement, that YOU initiated the topic about, that the 'regime' is being pulled back, has been stayed --
hence my post "that didn't last long"
just in case you care to refresh your memory -, the only 2 clawbacks of authority are 1st amendment related and humanitarian aid.
let me be PERFECTLY CLEAR - I think the tariffs are stupid, and anti-progress -- I don't WANT the admin to be right here, but like dodgy pardons, i am frequently reminded that it's his prerogative - and yet the IEEPA by a pretty open hand - I think in a plain reading of the law, trump wins this --

202, the President may, under such regulations as he may prescribe,
by means of instructions, licenses, or otherwise—
(A) investigate, regulate, or prohibit—
(i) any transactions in foreign exchange,
(ii) transfers of credit or payments between, by, through,
or to any banking institution, to the extent that such transfers
or payments involve any interest of any foreign country or
a national thereof,
(iii) the importing or exporting of currency or securities;
and
(B) investigate, regulate, direct and compel, nullify, void,

of, or dealing in, or exercising any right, power, or privilege with
respect to, or transactions involving, any property in which any
foreign country or a national thereof has any interest;
by any person, or with respect to any property, subject to the jurisdiction of the United States.
oh, isn't that precious -- unlike obamacare, this dusty old law has a severability clause, too

Mike MitchellThere probably are ways for trump to legally impose tariffs. The method and statutory provisions he chose isn't one of them and it's not gonna stand up.

Well the Affordable Care was passed and held constitutional.
Again, just like his attempt to deny due process through a contorted reading of an old law, this too will be held impressionable; again.
And this Court of Appeals has not held the lower court was wrong.
