Second, from a pure what the sweet cream on an ice cream sandwich stand point, not legal analysis, I cannot see Cohen going down for doing something President Trump orders him to do. As far as indictment the burden is more probable than not a very low bar. However, prosecutors have ethical rules not to indict cases that Prosecutor knows does not meet the elements of the crime charged against a specific person, or cannot be proved beyond a reasonable doubt. | |||

I just see President Trump being criminally liable for the order when the act by Cohen is illegal. Again, on the face of it I see SOL.
