Without seeing what is bf the Grand Jury, I cannot say. On the face of it, I would be concerned w the SOL. Surely, he knows that piece of business. Second, from a pure what the sweet cream on an ice cream sandwich stand point, not legal analysis, I cannot see Cohen going down for doing something President Trump orders him to do. As far as indictment the burden is more probable than not a very low bar. However, prosecutors have ethical rules not to indict cases that Prosecutor knows does not meet the elements of the crime charged against a specific person, or cannot be proved beyond a reasonable doubt. | |||

Every credible analysis I have read is “maybe on the misdemeanor” but SOL is a problem here. I just see President Trump being criminally liable for the order when the act by Cohen is illegal. Again, on the face of it I see SOL. Surely, the DA would not impanel a GJ with an SOL he cannot get over. There is not a SOL on any felony in KY. So, I cannot break that down. Never been and cannot be my problem to solve. | |||
