There are several flaws in your suggestion there is no duty that was breached. First, you ignore the statutory duties in New York--which supplement the common law ones.

Second, I would bet the loan documents contain representations from the borrower that were breached by the Trump gang.

Third, even if the loan documents contain no representations--which would be incredible in my experience--there is the common law contractual duty of good faith and fair dealing.

So it's silly to deny the existence of a duty.
