No unless a state conviction fully expunges (some states call it expungement but it is just a dealing of the record) or a pardon by the state or federal executive.

In the Fed law, there is actually a mechanism to petition to have one’s right reinstated.

I have never read of that being successful.


There is a movement in the federal courts working its way to the S. Ct., that a ban of transfer and possession by “non-violent” felons violates Strict Scrutiny.

That would be a pardon by the executive of appropriate jurisdiction.

A president cannot pardon for a state felony conviction.

Yes. The GCA of 1968 has an avenue to Petition. I just have never seen it work.

I actually see a constitutional cholla to the petition process as overly board not satisfying narrowly tailored prong on Strict Scrutiny bc the provision concerning petition gives unfettered, arbitrary power to deny petitioners.

To my knowledge, never looked that hard, no one has ever made such a challenge. Certainly, no such challenge made it to the S. Ct.

There is a felon in possession statute in Texas that differs somewhat from the federal charge. In Texas, if more than 5 years have passed since completing their prison sentence (including parole or probation), the law allows possessing a firearm at home.

Lyle Prouse was a Northwest Airlines pilot who was convicted of flying while drunk. The incident happened in 1990. He served 16 months and recovered from alcoholism and regained his pilot’s license. He was later pardoned by President Clinton, which allowed him to collect guns again. I heard about this a long time ago, but the only online article I could find that mentioned gun ownership requires a subscription for such an old article. Maybe you can work around that.
