No other defendant on bond w multiple violations of the court’s order would have had bond revoked on top of contempt sanctions to jail. Well, that is not legal analysis. At best, it is a conclusionary statement by a man who decided long ago without reading a brief what the what is. The Appellate Courts will resolve any issues of law that maybe in play. The Jury’s factual determinations will not be reviewed. You are going to have a hard time if President Trump is convicted and the convicted is upheld. He may be acquitted. That does not change or diminish his criminal contempt. That is a separate issue. He needs his bond revoked, and jailed on contempt. Like you would have long been. The court does not make orders as suggestions. | |||

The US justice system is by no means perfect, however, the main basic principles of a person is innocent until proven guilty, everyone is entitled to their day in court, a jury of your peers, makes that it get the verdict correct most of the time. Not always but most of the time. In this case with a very high-profile case like Trump if the jury finds him guilty you can pretty much bet there was a lot of evidence to prove it. It should not be this way but I have seen that it takes more and better proof to convict a high-profile person than a normal person. I will respect the jury's decision if they find him guilty or innocent I am ok either way because the jury had all the evidence, and I did not. | |||

I just would not do it with the intent bring to directly contribute to your campaign for office. That is what makes it a campaign contribution. The intent to directly benefit. That part of the law is easy. The hard part is proving the intent. Hence, why they called all the other people including Hope Hicks. To show a motive or plan by President Trump and Cohen. I think the whole trial is just a waste of time. It really does not matter if Trump is convicted or not it really does not make any difference. The election will go on and one of the two will win and one will lose. Trump is really in a no lose position, if he is convicted all the trump supporters will rally behind him and claim it's all a witch hunt and he was unfairly convicted and will still vote for him. In fact he may even get a few more sympathy votes. If he is not convicted then all the trump supporters will claim vindication and rally for him. The one thing that Trump is very good at is paying victim and getting people to believe him and support him. It reminds me of the old P.T. Barnum saying that went something like "there is no such thing as bad publicity" I believe that no matter who wins the election (I am not a fan of either Biden or Trump) that we has a country and democracy will be strong enough to last another 4 years until we get a chance to find someone else. Really should not have to explain this to another lawyer. In NY, falsifying business records is a crime. Recording a hush money payment as a legal fee is falsifying a business record. When you do the foregoing with an intent to commit another crime (in this case the payoff is alleged to constitute an illegal contribution to Trump’s campaign in violation of federal and state election law and/or alleged to violate New York tax law by inflating and falsely characterizing the reimbursement to Cohen) it is a felony. No one is arguing or alleging the paying off your porn star adultery partner is a crime . . . but covering it up by falsifying business records is. Going to have to dig deeper than a Fox News episode if you want to understand what is going on. Might even try reading the indictment and the relevant provisions of the NY penal code. Novel idea. If you get yourself into a position where you are on trial, and you disregard the judge's dictates, you get big trouble. Even if you are innocent of the charges. The system's way of handling it is to get through the trial and then go after the judge in court/impeachment. If folks don't want this kind of trial, then don't elect AG's like Bragg. Personally, from what I read, Daniel's conduct on the stand and the judge's conduct just handed Trump a walk. It may have to go through appellate court to get there, but geez, this trial is sounding bad. The prosecution's witnesses are saying Trump had nothing to do with it, and that he didn't do it. And some of those appellate courts have told you, you just cost your client a whole bunch of post judgment interest. I had a case that would have settled for a lot less. By the time, the KY Supreme Court got it and upheld it. The post judgement interest brought the thing into the stratosphere. Attorney Fees were capped by statute too. President Trump appealed the gag order. He lost. The law in NY on contempt is clear in this matter. 1k fines or 30 days per violation. | |||
