But now, Trump and seven other defendants have filed an emergency appeal, asking the presiding judge, Scott McAfee, to allow them to go right to the Georgia state Court of Appeals to overturn his decision instead of waiting until after the trial.

In their request asking McAfee to grant a certificate of immediate review, the lawyers said his decision didn't go far enough. They not only want Willis and her entire office thrown off the case, but the charges dismissed altogether, as some of them petitioned in their initial court motions back in January.

Either way, she is probably done.

Elected.
However, competence and integrity are quite often not issues in Fulton County elections. Cook County, Illinois May elect worse officials… but not by much.

Judge grants Trump request to appeal decision to keep Fani Willis on Georgia case

McAfee, in his Wednesday ruling, said the case will continue while the Court of Appeals works through the defendants’ petition.

In a statement to The Washington Post, Willis’s spokesman Jeff DiSantis said Willis and her office will continue working while the appeal is processed.

“As the case is not stayed during the appeal, this office will work to move it forward to trial as quickly as possible,” DiSantis said. “We will limit our comment on the appellate matter to what we file with the Court of Appeals during the briefing process.”

McAfee last week ruled that Trump and his co-defendants failed to “meet their burden” in proving that Willis’s romantic relationship with special prosecutor Nathan Wade and allegations that she was financially enriched by trips she took with him were enough of a “conflict of interest” to remove her from the case. However, McAfee did find a “significant appearance of impropriety” and ordered that either Willis and her office or Wade leave the case. Wade resigned later Friday.

The interesting part about the appeal is that the foundation case is not stayed.

Assuming that the appeal does not result in Willis' removal, the case will move along.

I think McAfee granting the appeal was a good move, because Trump and other defendants would have used the same arguments in appeal after prosecution. Now, it will be settled in advance, leaving less to argue about later, or at least less merit.

Maybe DA Willis will get her moment for this kind of summary speech:
