The courts have not been kind to law enforcement who arrest third parties who speak displeasure alone to arrest or law enforcement presence.
He just needed his face on TV.....pathetic stunt! He should have a margarita with a gang banger too!

C) If all he did was be present and yelled some stuff, including profanity, the S. Ct., has said that is insufficient to make an arrest. Cohen v. California, 403 U.S. 15 (1971); Lewis v. City of New Orleans, 415 U.S. 130 (1974); and Gregory v. City of Chicago, 394 U.S. 111 (1969).
The appellate courts have carved out true threat exception. Meaning when someone makes a declaration of a true, non-conditional, threat or incitement to lawlessness.
More likely than not he can film ICE arrest and interactions. The S. Ct., has never overruled that holding from Glik v. Cunniffe, 655 F.3d 78 (1st Cir. 2011). Most Fed Circuits have adopted this rule. The lack of Circuit division is one reason it has never went to the Supreme Court.
Thus, he being present for ICE law enforcement actions and yelling at them is not a crime. There is recent caselaw that makes it somewhat easier to sue law enforcement who violate your rights.

The arrested is clinging to the illegal, pushing ice hands away, refusing to follow lawful orders, demanding to see a "judical" warrant, refusing to comply, and absolutely inferring with ice lawful duties. There was a photo of that man in custody.
Again, if all he is doing is telling dnd refusing to leave, that is going to have a hard time surviving judicial scrutiny based on the S. Ct., and Fed Cir. Ct., law above.

c) The obstruction, impairment or hindrance of an arrest.
I’m sure the Feds have a similar charge.

The cases above do not protect, recognize as protected speech, this behavior.
Had he just stood there and asked to see a warrant, the law would agree with you. He did not. The law does not so permit.

LHeym500You can stand and yell just about all you want. The law protects that. It does not allow, permit, nor protect physical actions.
He has a hold of the guy. He is pulling along. He is refusing orders (not dispositive). It is very crowded. He is physically holding on to the detainee. Again, a very close, tight crowd. He is pulling the detainee while bumping LE. He needs to be treated like everyone else and feel the stick.
My biggest issue is he is physically holding the guy they are trying to remove from this tight crowd. Clear violation of our state statute.
Sorry, the law is just not in this guys side.
If someone wants to make a policy, morality argument. Okay, but there are better examples to use. I mean John Brown is a folk hero now. His actions were wrong, but he was lionized on his tone. He also suffered the legal consequences as this man should.
