If you own land in Texas and wish to provide yourself with a bit more liability protection, you might consider posting a sign as described below. If you want to read the full text, it's in the Texas Civil Practice and Remedies Code.
Hunting and fishing is covered.

Sec. 75A.003. POSTED WARNING. For the purposes of limitation of liability under Section 75A.002(a)(1), an agritourism entity must post and maintain a sign in a clearly visible location on or near any premises on which an agritourism activity is conducted. The sign must contain the following language:

"WARNING

UNDER TEXAS LAW (CHAPTER 75A, CIVIL PRACTICE AND REMEDIES CODE), AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AN AGRITOURISM ACTIVITY."

purchasing new homewoner's insurance, insurance agent and I were discussing law suits, I told her if someone was breaking me with a law suit then that someone had better have heirs he cared about because he wouldn't survive the settlement. She gave me one of those "I've got a nut in my office" looks and, she was right. Kensco is near top of my list to sign above in Spanish and English. Smiler

Killing people who fuck with you is way underrated as a solution these days.

Nope. Just English and if you happen to have horses on your land, there is a similar statute offering protection for equestrian activities.

Long ago, my Mother's family owned land where Hugo Lake is now located. I can remember in the mid-60's some of my Uncle's operating a saw mill and a still way back in the woods. I also remember the Sheriff coming to my Grandmother's house to inquire about a "couple of feller's" that somehow got tangled in rope and ended up in the Kiamichi River near the family sawmill. Nothing ever came of it, Choctaw County was pretty rough back then.

This is an absolutely true story. Just after I bought my first piece of property in this area back in the mid 90s, I and the guys who were helping me build fence were eating lunch at an easily recognized cafe/grocery/beer joint on 259 not far into OK, a mile or so from the Red River. I knew duck season has closed in Ok the weekend before so was surprised when I saw a bunch of camoed duck hunters (labs in truck was the main clue) come in for lunch. Not having come in on the last turnip truck, I didn't say anything, just nodded. Next day, same group, same deal. So, after finishing the lunch burgers, I said "How was the hunting?" "Great, we killed a bunch of mallards." Since I was already into it, I said, "I thought the season up here was closed." Guy looked at me, straight in the eye and said, "This is McCurtain County, we hunt them until they go North. Wanna come with us tomorrow." I quickly assured them that Federal charges were not on my preferred list and declined. They said, "Only 2 wardens in McCurtain Cnty, OK and we know where they are all the time." True Story.

My distinct impression at the time was, it wouldn't do to interfere with these guys duck hunting IN ANY WAY!

Several years ago the Texas Legislature passed a law that painting your gateposts purple serves as a posted,no trespassing sign.It also means that even CCW holders may not enter the property armed unless given permission.


Never mistake motion for action.

I agree with you Gato. A few years ago my eldest son who has the 5 acres next to me had not paid his land taxes + I did'nt know about it. One day this black suburban pulls up in the yard + says that they were from Williamson County + here to seize the property.Well,let me tell you ,"Calm Down" left 30 minutes ago. Somebody was going to get shot. We figured it out finally + all was resolved but at the beginning I was ready to die to keep my property just as I was willing to kill anyone trying to steal it.

Yup. A colleague of mine has his corner posts painted purple. The consummate tease was that he was a fag and the color purple meant he was gay..................not that there's anything wrong with it

30.06 and 30.07 of the Texas Penal Code:

30.06 Specific Requirements (as laid out in the above statute):

1. Explicit Language Required: “Pursuant to Section 30.06, Penal Code (trespass by license holder with a concealed handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a concealed handgun”2. Must be in English and Spanish 3. Appears in contrasting colors with block letters at least one inch in height 4. Is displayed in a conspicuous manner clearly visible to the public

Explicit Language Required: “Pursuant to Section 30.07, Penal Code (trespass by license holder with an openly carried handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a handgun that is carried openly” 2. Must be in English and Spanish 3. Appears in contrasting colors with block letters at least one inch in height 4. Is displayed in a conspicuous manner clearly visible to the public.

This is part of the License to Carry Law and has NOTHING to do with the above referenced law regarding liability of agri-property owners. Specifically it refers to signs saying that a person may not carry on prohibited property even tho they have a LTC.

Hunting, fishing, camping, hiking, trail rides - horse or ATV.

Basically any activity on Private Land, outside of normal farming/ranching practices, that the general Public arranges to take part in.

That is probably too simplistic an explanation, but even with family and close personal friends, a landowner takes one hell of a risk allowing people on to their property, that is why a lot of them won't!
