This story I have posted on Miscellaneous Topics already but a member recommended to post it here as well.

In 2011 I paid to a Lakota author $ 750, his name is Joseph Marshall III (jmarichale@gmail.com). The money was the deposit for bow, arrows, bow case and quiver. archer After some years Mr. Marshall informed me that he has no time to finish the items but he would refund me. Money was transferred from my German bank account into his bank account.

I was very disappointed and angry. I mean, why did he accept my order plus the deposit? I'm still waiting for my money. I have sent him countless emails, Mr. Marshall never replies. He is a well-known author, he has written many books on native americans. Marshall is pretenting to be a good man, but he is the opposite, he glues to my money. I also made contact with a lawyer at New Mexico, but involving him would be too costly.

Now I would like to give my story to the press. Do you know of any newspaper or magazine which might be interested in publishing it? He hails from South Dakota but is living in New Mexico, in Albuquerque to be precise. I do have his full contact details but from South Africa I can't do much. He is aware of that of course. What a pity that I have sold my Winchester 73 .44-40 ... BOOM

You could file a charge of Mail or Wire Fraud with the DA in Albuquerque. Statute of limitations is 5 years so you better get moving.

You have been scammed my friend. Either pay many thousands of $$ to pursue legal action or write it off as lessoned learned. Perhaps next time a small deposit and complete payment upon receipt of finished goods?

Still, I would like to see my story published in a newspaper or magazine but I don't know which one to contact. Mr. Marshall isn't just an average person but a well-known author. He even featured in a Stephen Spielberg movie (Into the West). Therefore the press might be interested in his doings.

I contacted the Better Business Bureau Serving New Mexico and Southwest Colorado, 7007 Jefferson St NE Set A, Albuquerque, NM 87109: "We regret to inform you that the Better Business Bureau cannot process your complaint. The case has been reviewed by one of our Complaint Specialists and was found to contain issues that are out of BBB's purview. It is our policy to process only those complaints that fall into BBB's scope. Items such as criminal allegations, requests for punitive damages, employer/employee disputes, cases already involved in litigation, civil right violations, business to business collection issues, etc are not handled by BBB. We would like to thank you for bringing this to our attention as it will allow BBB to monitor the company’s complaint activities.
If you have any questions, please do not hesitate to contact us. We are happy to assist you."

I understand it is only 750$ but it is the principal of getting ripped off, I get it.
If I were in your shoes I would continue to contact him whether he responds or not and keep that paper trail specifically any emails where he said he will refund your money.
Contact the local County sherrif or Police dept. and file a complaint. A visit from a Sheriff may urge him to refund the money.
When dealing with the cops remember they don't want to hear all the drama they want the facts: date you entered into a contract (sent money) date he said he would refund and dates that you've tried to follow up on collecting.
It may be lost money but by applying pressure this way you may get it back. I would look at it as a fun hobby trying to apply heat to him.
As for contacting newspapers or movie companies No one will care about demeaning his character publicly.

Most states have a small claims court. You don't have to hire a lawyer but you do have to present your case. You might look into that.

Did any part of this go through the US Post Office?

Good reason for postal money orders or at least Mailing as part of the contract.

How about anyone in your bank able to contact his bank and make in "inquiry".

Forget it and move on. You are letting this small loss consume you. Nothing you are going to do about it that would get your money back or satisfy the desire for retribution. Been there...done that. Sad situation..but there are worms in this world.

If this gentleman is still actively building and advertising as such you may want to post on some of the traditional archery sites. You may get a lot more mileage from that crowd.

It has nothing to do with money. Fact is that Marshall is a very well-known person with whom I entered into an agreement. He accepted my order of bow, arrows, quiver and bow case. Years later he wrote sorry, I don't have time to finish the items but I gonna refund you. Which he never did.

You may wish to try the New Mexico State's Attorney General.

Objectively state your case and the facts. Include e-mail especially the e-mail in which he states he failed too complete your project and promised to refund your money.

Consideration. As he is Native American and IF he is living on a reservation/tribal lands he is out of the jurisdiction of many Federal, State and Local law enforcement agencies for many concerns. Many things of this nature are the domain of the tribal police. This is probably why the BBB will not do anything.

When I had a run in with a Maine gunsmith, I live in Texas, the BBB did file a complaint. The Maine AG sent him letters and visited with him.

Thank you, now I know why the BBB didn't do anything besides sending Marshall a letter. He is enrolled with the Rosebud tribe in South Dakota but living in New Mexico in a city.

I gonna contact the Attorney General - thank you for the good advise. By the way, $ 750 isn't just peanuts, for that amount I get a return ticket Frankfurt / New York!

has anyone thought to contact the tribal council of the Lakota people? I don't know about the Sioux but the eastern tribes run a pretty tight ship and would definitely look into something like this if it was one of their people.

Me, I have contacted many Lakota at Rosebud reservation, also their press, none of them wanted to hear the story. Marshall is most likely the most 'famous' member of the tribe. Besides, to steal money from white people - what's wrong with that...?

Sorry, I know how frustrating this can be.. I would reiterate what others have said, and present it to the Attorney Generals office for that State.. He has to come off the reservation sometime... Plus at that point it becomes a public record..
