Sorry mods don't know where to post this. I was hit a little over a month ago in a crosswalk by someone without insurance. The only saving grace is that I have underinsured/uninsured motorist coverage. Some states mandate it. I will have to fight my company to collect it but the alternative would be nothing. Please make sure you have this coverage it is cheap and covers you as a pedestrian too. To be honest I didn't even know I had this coverage until I needed it. Thankfully though the lady ran a yellow/red light and hit me doing 45 I will walk again though one leg is being completely reconstructed. At least I will see my baby girls face when she is born in April and it could be so much worse. Just make sure and take care of your family.

Great reminder on the insurance. Is it part of your homeowners or your Auto policy?

She ran a yellow/red and had a slew of felonies and no license or ins. The officer didn't give her a breathalyzer or assign blame. I had a bright green shirt on. Hate to have to hire a lawyer but the ladies boyfriend called here while I was in the hospital and yelled at my 7 mo pregnant wife because my body totaled their 2000 car and he had to ride the bus to work She doesn't work cause she is waiting on disability SS to pay her. All I can say is it was a good thing I was in the hospital

Dang man, sorry to hear of your misfortune (but good to hear you'll recover). Are you sure you don't live in New Mexico? That's the kind of crap that goes on here all the time with drunk drivers and bad insurance (and yes, we're supposed to have uninsured motorist, but many don't get insurance at all).

Before you hire Larry the Lawyer, let your insurance company work with you, and then you can decide if you need help.

I had one of my insureds in a similar situation and when the case was done, Larry the Lawyer sent her a check for under $10 (yes, ten). Larry apparently had lots and lots of expenses over and above the 33%. Lawyers usually charge 33% of the 'winnings' plus expenses.

To Snellstorm, the Uninsured/Underinsured Motorist coverage is part of your auto insurance policy. It's optional coverage in my state (Colorado). It pays for all sums you are legally entitled to collect due to Bodily Injury caused to you by an Uninsured/Underinsured motorist.

Sorry to hear it. I hope everything ends up as good as possible. I also hope the laws are better than Kansas. Kansas is a no-fault state and this stuff has to go through your insurance first, who will then decide whether or not to go after the other person. Their choice. When your injury part runs out, then they just tell you it has to go through your personal health insurance. Sucks.

I would disagree with k-22hornet, somewhat. My daughter just went through the same sort of thing, albeit in Kansas, and without the lawyer she would have received nothing except some of the medical paid and, in her case, the car fixed. Insurance companies do not collect for pain and suffering, which you have a LOT of. Get a good by-the-hour lawyer and go for it. Of course, if the other side has no $$$, there will be little or no gain anyway. My daughter at least got $25,000 that is eaten up pretty quick with the stuff the insurance company will not even attempt to pay for.

Remember that insurance companies are there to pay as little as possible, but collect all the premiums possible. Not a condemnation on insurance companies, just the facts of the industry. They have to make a profit too.

My uninsured, unlicensed baby's mama hit you > it destroyed 14 year old car > had you not been there it would not have happened > It must be your fault.

Don't be surprised if they try to sue you for walking.

I have USAA insurance and as good as they are they denied the claim because ding,ding,ding the cop didn't assign blame so now it is lawyer or nothing. I hate it because I am sure it will be pennies on the dollar by the time I am done. Makes you wonder why in the heck you buy insurance if they won't insure you.

You have a certain amount of time to appeal the denial. I would do that. It is common practice to deny all claims up front from USAA and wait for the appeal. I have never heard of a claim they agreed to the first time.

Then go to the insurance commissioner for NC. That sometimes helps before you need to go to a lawyer.

What a bummer! I agree that you need to run this up the chain of command until you get to a manager level. The underlings just do what they are told and you may need to "explain" things to someone who has some authority.
