I got a notified today from BATF advising that an FFL holder must have to apply to California Department of Justice to get a permission letter to ship guns under an FFL to a dealer in the state. But if you are not an FFL holder you can ship a gun to a dealer in the state. What is going on in that state do they think the gang bangers and bad guys care. Looks like it will just drive the gun business further under ground. I for one will not ship another gun to that state for any reason period. They must be run by Ebay. That law has been in CA for some time now. A “regular†CA citizen cannot purchase a firearm without having a FFL or having bought through a FFL dealer. And for a “regular†citizen to get a FFL is impossible, unless you have a Firearm business (that is not run out of your home). The state has gotten rid of the “at home/internet gun dealersâ€. Californians that have their FFL before all this started are very, very lucky. It’s extremely hard to get one now (I have already tried). It’s a pain in the a** but most of us (Californians) are use to it. You just have to wait the 10 days. And when you wait your 10 days and bring it home some gangbanger robs your house. | |||

It's a different law. The new law that goes into effect on July 1st says that out of state FFL dealers and manufacturers have to obtain a verification that the FFL licensee that they are shipping to (in CA) is current before they can ship firearms into California. Out of state licensees log on to the secure server at the CA Dept of Justice and check that the person receiving the firearm has a current FFL. Once that's done they get the approval number and can ship the firearm. "I for one will not ship another gun to that state for any reason period. The ATF doesn't want non-businesses having FFL's. To get ANY type of FFL you must be engaged in a FOR PROFIT business with all the proper state or local issued BUSINESS licenses. Close the business - lose the FFL. This is a federal not state law. | |||

The location is up to the locality, city, county, state, etc. You must be conducting a business for any of them to recognize the FFL. There are a few guys around who still sell guns from their home but they've had the license forever and have met all the requirements of running a business. Can't tell you what other states allow. I believe in many states you can sell face to face with no FFL required. Again - no business - no FFL. About 10 or so years back the governments in CA started revoking business licenses for people who were Kitchen Table dealers. They were businesses in name only - buying for themselves and friends, family etc. | |||

The State's DROS fee is $19.00 which covers the costs of the background checks and transfer registry. There is also a required $1.00 Firearms Safety Testing fee and a $5.00 Safety and Enforcement fee. If the transaction being processed is a dealer sale, consignment return, or return from pawn, the dealer may impose other charges as long as this amount is clearly shown as a "dealer fee" and not misrepresented as a state fee. In the event of a private party transfer, the firearms dealer may additionally charge a fee of $10 per firearm transferred. Most transfers TO kalifonia are going to be charged sales tax on top of DROS fee on top of the dealers fee. for an example you can look here. you will see most dealers collecting $50 + DROS + Tax. | |||

I received that letter yesterday. Basically, if I sell a firearm to someone in CA, I have to first get a permission letter to send it to the receiving FFL. The kicker is, a private party does not have to get the letter. What are they trying to stop? Basically, they have just shut sales off to Californians for me. Ebay, that rant could last for months! they are not trying to stop anything. they are attempting to use a less desirable member of society (in thier eyes) pay additional taxs. It is a way to further tax the people without complaint. | |||
