This was reported by all the news networks,morning shows, fox and was in quite a few papers I looked up on the paperboy.com site. Validity is its a true case. What other reasons there are for it are not spelled out in either article. Brokaws story in under the one about harrison ford creating an elk refuge. There are implications in this just there are in suits issued in ILL,NM,AZ,NV,UT and every where else this is going on. Elk living near Ford's ranch belong to the larger Fall Creek Herd, which numbers 5,100, exceeding the state's population objective of 4,400 animals. "The problem is that a lot of landowners don't allow permission to hunt," said Mark Gocke, spokesman for the Wyoming Game and Fish Department. "That's why this particular herd segment has grown so much." Ford has created a private elk refuge of sorts with elk summering on his property in South Park. "(Ford) doesn't want any hunting to take place on his property," said John Kelly, who manages the ranch for the actor. "He told me that if I caught anyone to turn them in." Kelly said he's placed signs warning would-be hunters along the border between Ford's property and that of a neighbouring housing development. State officials want to thin the heard to protect cottonwood habitat on the Snake River. They also are concerned about elk mingling with cattle because of the potential for transmitting diseases and because elk may damage stored hay. (AP) -- Lawyers for "NBC Nightly News" anchorman Tom Brokaw want a judge to require the Montana Board of Outfitters review a decision that allows a Wyoming outfitter to guide big-game hunting trips on land next to Brokaw's Montana ranch. "The complaint we have is safety, plain and simple," Clifford Edwards, a Billings attorney representing Brokaw, told District Judge Nels Swandal at a hearing Friday. "Tom and (wife) Meredith are not anti-hunting -- they are concerned for their safety." On Sept. 1, the Board of Outfitters granted Wyoming outfitter David Nelson's request to take up to 10 hunters onto 2,500 acres of private land bordering the Brokaws' West Boulder Ranch during archery season, court records said. Wayne Johnston, executive officer for the state Board of Outfitters, said the Brokaws allow bird hunting on their property with shotguns, but are trying to stop neighbors from allowing archery hunts. "The Brokaws are trying to tell their neighbors who they can and cannot allow on their property and for what reasons," Johnston said. "It seems like an infringement on their neighbor's property rights." The neighbors were not identified. West Boulder Ranch caretakers Karen and Doug Campbell testified Friday that increased hunting would put them, the Brokaws and their guests in harm's way. "I'm terrified someone will get shot," Karen Campbell said, adding she was "not so sure" outfitters knew their client's hunting skills well enough to ensure the Brokaws' safety | ||

Yup. This could very well affect EVERY hunter in America. It gives the anti's another stick to put on the fire and another precedent to cite in their ongoing harrassment of hunters. Think about the eastern hunter that has 100 acres to hunt. Folks that you don't know, that don't even live next to you could be hassling you about the "safety". | |||

The problem is that there is no way that the guide can guarantee that a bullet will not trespass on the Brokaw's property. This is trespass, not nuisance, like noise. | |||
