Dakota filed for liquidation

I just read Koos Barnard's article in Man Magnum about Pete Kennedy's latest import from Dakota Arms - a beautiful 375 H&H, custom built for Pete, to become his only rifle to back-up his clients. Seems he agrees with Harry Manners that he does not need anything bigger. Pete was also PH of the year in SA - I think about 2 years back.

Sadly, the article states that Dakota has filed for liquidation. Hope someone will not let the Dakota 76 design go to waste. Any observations, or opinions, and/or experience with Dakota's rifles are invited. The Dakota is not often seen here in SA, thanks to the Arms Embargo that the USA government imposed on SA.

Some custom gunmakers here do offer their actions and 3-position safeties as options though and that is where I saw Dakota's design - looks spiff to me.

Their bolt handles are first class as well.

I wonder if they will sell the tooling for this stuff?...how does one get to bid on it?

Which Federal District Court Bankrupcy Office is handling the case?...is that information available?

Dakota has filed for bankruptcy but has not yet presented a plan for reorganization. Dakota Arms filed with Judge Kressel in the Minneapolis Bankruptcy Court (case number 06-41315).

Possibly a cultural difference - in the US, "bankruptcy" does not necessarily equate to "liquidation," though it can mean that also.

Yes, I agree, it seems like a language/culture difference. In Australia, few businesses that file for bankruptcy do anything other than an asset sale/wind-up. I guess its much the same in SA. I know it’s more common to use bankruptcy to restructure the company/debt/etc and trade out, though liquidation can still occur.

Assuming that Dakota Arms is a corporation, then a reorganization filing is in Chapter 11, which is not a liquidation of assets. If they were liquidating, then they would file Chapter 7, and of course there is no reorganization plan.

All we can hope for is that they have to sell off the Miller Arms two single shot designs; so they can be put back into production by someone who will be proud to build them, priced to actually sell. If I ruled the world (or ran this court) the first provision I would mandate is that all of the management crew gets thrown out and a lien filed on their personal assets. That is EXACTLY the problem, corporate bandits rape a company and then get to walkaway with a pile of $$$ and on to their next victim. I pray that this court pursues any allegations of impropriety and looks at jail time for that lardass Kokesh.

Ladies and Gentlemen:

Just looked up the Dakota Arms filing in the Minneapolis Bankruptcy Court website, and they filed for Chapter 11 Bankruptcy on July 6, 2006. Since it is a chapter 11 filing, then no liquidiation unless it is forced by the creditors.

In the Fall "06" issue of Wild Sheep/F.N.A.W.S Tony Caligiuri States that Dakota Arms filed for Chapter 11 protection 3 months ago..They continue to ship rifles and hope to be out of Chapter 11 in 1 year..He also states that the Court has said all deposits will be applied as Rifles are completed..Deposit are "Technically Unsecured" as he puts it.. Mr. Caligiuri has a deposit pending at this time..
