Is this normal? It sounds like a one sided contract.

Charl, Thank you for posting this here. A couple of points caught my attention, which you might wish to look into. My understanding is that once a contract is eneterd into, and a deposit is paid, terms and conditions cannt be changed. Observer to hunter daily rate. When I was looking for an outfir to hunt with in South Africa, this was a point I did not like. As some of our friends only wanted to shot an animal or two during their two weeks safari. Some outfitters I talked to insisted that the status of the observer changes as soon as he shoots anything. One outfiter in particular - Peter Harris of Ntshonalanga safaris - went the other way. He did not just waive this requirement, but gave us a daily rate for everyone - includng the hunters - that was normally given to an observer. Needless to say, we hunted with Peter again. And he is is my first choice if I wanted to hunt in South Africa.

Saeed and dddunn, Thank you for your replies. Although this condition can be found in many Outfitters contracts in south Africa, the concerns is of course understandable. Our side of the coin is this. If a client books a Safaris now, for 1 year from now, and our total economy collapes, we must be able to change our arrangement with the client, for better or worse for him or us. This was advised to us by a seniour member of PHASA's exco, when we drafted these T&C's. It stays dark Africa after all. I am more than happy to remove this condition from our contract, as it is not a big deal for us. I copied and pasted it from our contract into the advertsiment. As far as observer rates goes. I know that a lot of people have different opinions on this, and I respect that. I change my mind a lot about prices when people engage in correpsondence and we look at the bigger picture of the booking (read I'm open for negotiating). This particular hunt we realy want 2 Hunters to share the package. Saeed, there are an AR member that can testify to this, as we have not asked his "observer" a cent extra, but he shot a lot of animals, and she a one Impala.... Observers eat the same food, get the same service, they also go on the truck, they just do not need a guide in the bush (read extra PH) and that is why we charge less for them than hunters. Some people change their mind, and then they become full fledged hunters when they get here. That is why the condition is there, and why I will never change it. In practise though, I can give ref. of a lot of hunters that paid observer rates, and the observer then shot an animal or two without me charging a cent extra for (ussualy) her. I will make a concession on the request posted here. If this hunt is booked 2x2 as we would like to sell it, any observers are welcome to join us for $100.00's per day each. And the observers are welcome to shoot an animal or two....without being charged extra, save the trophy fee of the animal. I hope this looks better, and I have now ammended the original post. This should now be more attractive, and we hope that these changes would put your minds at rest. Like you Saeed, I hate these written contracts, terms and conditions, and other nonsense. I still like to do business the good old way with a handshake. Sad thing is that the world had moved on.... and some of the recent posts here is living proof of that. To this day I have not had ONE BAD experience with a client, simply because I am always prepared to be be the lesser man, and give the client the benefit of the doubt, as I believe FIRMLY in a African hunting experience must be the best one he will ever get, and that money issues MUST not ruin it for him/her........ I look forward to your replies. I don't mind seeing the highlighted language in the advertisement/offer of the hunt. It tells me that they may not be able to honor this offer 6 months from now. However, I don't expect it to be in the actual contract. I expect the contract price to be firm and not subject to change or further negotiation. Otherwise, the package looks very nice and affordable. I second what Saeed said, I hunted with Ntshonalanga Safari's and they were a first class outfit!!! if you weren't happy with anything, they would go out of their way to take care of situations, they are all about customer satisfaction and want people to come back, You can't beat their deals for S. Africa!!!... And I will hunt with them again!!!

I agree with the comments on the contractual language. However, those are good prices, especially when you take the edited video into consideration. That's a value of at least $150 daily. _______________________________
