Alan,

Napha and Phasa did not act as the whole matter falls outside the mandate both organisations have.

I understand that the CLIENT shot the guide. The big problem lies in the compensation claimed that was totaly out of line. Herman is a lawyer himself, and as I come from the same bloodline would have done the same. Nothing done untill a summons lands on your table.

I can assure you that if they were in the wrong PHASA would have asked them to stand down from the EXCO. They have this year scrapped another OLD member. One that I nearly picked up big shit with last year after posting about him here. Now he is gone.

There are a lot of stories, and the way I see it, the whole issue should be left in peace until something worth reporting happens.

I can assure you that Herman did nothing illegal, and was not charged by the Namibians during these past three years?!

Also, as a good friend of mine pointed out recently, the ethos of a wounded animal should come first, and then countries laws and rules.

Take note that although PHASA and SCI (like many other hunting organisations in the world) have very close ties, the two organsiations are very very different in nature.

[MMS quote]Truth be told, the only reaason there are any mutterings of illegal hunts is primarially to extort exorbidant sums of money in connection with the tracker shooting incident. Restitution was offered and declined.
[Vanderhoef QUOTE] The focus of this thread seems slightly off track to me. The real issue here is that the tracker was horrifically disabled by a foreign hunter that, as far as I know, has refused to offer any sort of compensation and is apparently justifying it by hiding behind a technicality...
So on the one hand money was offered, and on the other it was not. Troubling.

Onefunzr-

To be clear: the information I have is over a year old and clearly there have been new developments. Last I heard, Paul (and quite possibly Hermann) had offered to compensate the tracker, since the hunter was refusing to do so. As to whether the offer was (not saying it was a "settlement" offer, just monetary compensation) accepted or not, I have no idea.

Let me reiterate, both Hermann and Paul were/are very, very concerned about the tracker and told me that they were doing everything in their power to try to rectify the situation.

Apologies if I confused anything or if the facts as I know them have changed. This is a very sticky issue with some fantastic reputations at stake here and I certainly don't wish to muddy the waters. As has been said, it's best at this point to let the powers that be sort this issue out, but make no mistake, Paul and Hermann are the good guys here!

Regards,
Scott

May I ask if the PH/outfitters take out insurance against this sort of thing happening?

If not not, why not?

Just like medical evacuation insurance, some safari outfitters insist that you have it, and when you think about it, it really costs very little for the peace of mind it gives.

I think it generraly costs less than $200 to insure an individual on a his hunt.

May be some of the answers might throw some light on this, as it seems to be quite a complex issue.

I think it is unreasonable to expect a visiting client to be fully responssible for something like this happening.

Why is everyone making a stink about the phs and outfitters? It sounds to me like there probably was some bad judgement used and they might have crossed a legal line. I am not defending that. I am just wondering why the attention seems to be diverted from the gentleman who actually had the weapon discharge and wounded the tracker. Where is he in all of this? Sometimes shit just happens but it is what you do about it after the fact that matters.

as lawyer I can tell that in Italy each hunter is obliged to have an insurance policy for damages against persons or things. I do not know if the hunter author of the injury had his own insurance but, knowing the insurance companies, it is likely that, if something in the hunt was illegal, they refuse to pay
